I pretty sure you cannot get arrested for cussing. You can get a ticket like jay walking. This is so unnecessary that I hope the police officers are fired. Stupidity at that level makes the badge look embarrassing and should make the officers that work in Baytown angry. They probably got them on disorderly conduct but I'm sure charges will be dropped.

The incident happened at the Baytown Market store Tuesday in the 2900 block of Market Street. Officers pulled over a 23 year old black man for a traffic violation. When officers handcuffed the man, two people in front of the store began to make comments about what was happening. In the video, an officer can be seen crossing the parking lot to the store's front and throwing a white man on the ground, then kicking him in the head. A second officer confronts a black man who was also in front of the store and eventually arrests him. Skylar Gilmore, 24, and Isaiah Phillips, 23, were arrested for disorderly conduct-language, for their public use of profanities. A Baytown officer is also heard on video using profanities. The Harris County District Attorney's Office filed charges against Gilmore for interfering with public duties. Baytown P.D. issued the following statement: "On June 2nd our officers conducted a traffic stop of a vehicle in the parking lot of the Baytown Market Convenience Store located in the 2900 block of Market Street. During that stop the driver of the vehicle, 23-year-old Jostin Moore of Baytown, was arrested for traffic violations and an outstanding warrant out of Deer Park. During the course of the stop, a small crowd made up of several of Mr. Moore's associates began to gather outside the store. Two members of that group, 24-year-old Skylar Gilmore and 23-year-old Isaiah Phillips both of Baytown, were subsequently arrested as well for Disorderly Conduct-Language for their public use of profanities during the incident. Mr. Gilmore was also charged with Interfering with Public Duties through the Harris County District Attorney's Office for his actions during his arrest. Baytown Police Chief Dougherty has referred the incident to our Internal Affairs Division to conduct a complete and thorough review of the incident."
So the first dude that got handcuffed by the Mercedes was taken for an outstanding warrant and traffic violations? I guess the other guys didn't know him? I'm asking because the camera guys started yelling the Mercedes guy was being handcuffed because he was black and he had done nothing. In the video that JR posted above (not in the OP), the first thing they do is drive up and say something like "let's see what they do, I'm going to start recording". That's not in the video ThatBoyNick posted. Wth. Confusing as hell. Cops messed up when they let the camera guy and his buddies get to them. That was dumb. This whole thing was goofy. lol.
I reas at one point that police can only ding you for that if a third party hears it. If it's just you and the cop it isnt disorderly conduct, but maybe something changed. Reading the reddit thread, seems like this officer is kind of notorious.

The guys do know him, the white guy was on the phone saying they are arresting "saba?" So they were probably on their way to meet up with him and he texted them he was getting pulled over so they pulled up and started recording.
Oh, ok. I didn't hear that. If the guy has a warrant and outstanding traffic violations like the article says, these guys seemed to have escalated that for no reason screaming he was only being handcuffed because he was black. The cops escalated even further with that knee to the head and arresting for cursing or whatever. Questionable judgment all around, if you ask me.
I'm gonna guess they probably didn't know about it, they probably genuinely believed he was getting pulled over for no reason. Regardless, personally I think the cop should be fired, The guys were a good 30 feet away, weren't being aggressive, if your skin is so thin that you cross a parking lot to slam a guy on the ground, knee him in the face, arrest him for doing some light ****-talking then you shouldn't be a cop.
