Interesting, I think this has to do with the account. If you burn the music or put it on a physical device then it's yours, how could it not be, but your account may not be transferrable.

I believe Willis will lose this case. Apple is a major business partner which can set it's own rules when distributing digital assets. You only "own" downloads to those that are tied to your account. If the release scope is physical, then you can transfer the CD to someone else. There are so many caveats, rules and exceptions when it comes to the digital supply chain. (I work for a major music recording company)

 

You can transfer the CD.....but not the music on it (legally) unless it goes WITH the physical CD.

Meaning, when hotballa buys a CD, he may own the physical CD, but the content is protected from redistribution. So if he makes a copy of that CD and sells or even gives it to someone else, he is in violation of the copyright protection.

That's correct. Burning a CD is an act of piracy. When I say transfer, I meant it can be given to someone as a whole.

Yes. That has always been the case. They will not let you re-download it.

 

They often will, but it's entirely at their discretion.

Makes Spotify and similar services seem more reasonable. Or the Pirate Bay.

If you have iCloud set up, your purchased (and even ripped) music stays there forever and you can remove it and re-download it at your leisure.

 

The used CD store is simply reselling the physical media. A person is infringing on the copyright if they rip the music to their computer and then sell or give the CD away. There is nothing wrong with buying a CD, listening to it, getting tired of it and then selling it or giving it away.

 

I never had the time to realize it but, yeah. Wow.

I don't get it...why couldn't he just leave his kids his login information so they could access and use his account after he dies? I know it's a matter of principle but sheesh...

No. Go to iTunes and under the "Purchased" tab on the left there is a section that says "Download previous purchases". I've been re-downloading stuff I bought 3 years ago.

If it has to do with why is the licensing different on a CD as opposed to iTunes, it has to do with the deals Apple made with the record companies.

 

You don't own a copy of the song on iTunes. What you get is more like a license for personal use of that song. You can listen to it forever, can make limited copies etc. but you can't pass it along because you don't have the right to a copy.
