Now, first... I don't know if there's even a bird called a "midnight warbler" but here's the deal... I've got a bird, or birds, in my neighbor's tree behind our house -closest to the master bedroom window- and it will NOT stop chirping/singing/warbling at ALL hours of the night. What can I do with this situation? Any bird experts around? It sure doesn't help my insomnia, that's for sure. edit: is it the great State of Texas' own Mockingbird? (so I can't do a thing, can I?)
If you could either describe the markings on the bird or describe its call, that might make it a bit easier.

I had a friend in college who had a woodpecker outside his window that would keep him up when he wanted to sleep until noon every day. So he got some rope and tied it to one of the branches outside his window then had the other end come back through his window and stay next to his bed. So when the woodpecker started making noise he would start puling on the rope to shake the branch to scare the bird away. It was like out of a cartoon or something.
i heard if ithey are small to medium sized burds you can put up a fake owl to scare them away. They sell them at Lowes in the bug spray section
And after a week you'll have a plastic owl covered in bird crap. Supersoaker. Failing that, pellet gun.
When I was a teenager, I had this big tree right outside my window. On this tree right outside my window, was a little knot. The perfect sized knot for a bird or squirrel to sit on. I routinely would have squirrels sitting out on that knot early in the morning eating pecans and barking at his friends. When they would do that, I would open my window and shoot them.
sleep during the day... then at night go out there and make a louder noise using some sort of funnel to amplify the sound and aim towards the tree where the bird is. That way the bird will see what its like and he will understand and stop. Or he could fly at you and peck your eyes out.. either way it should make for an interesting project.
This summer buy a couple strings of Black Cat firecrackers and a real big aluminum garbage can. Put the can under your neighbors tree, light the firecrackers and throw them in the can. When th birds fly off shoot them with a shotgun.
