I recently got a speeding ticket, and I can't do defensive driving because one of the requirements to take it is that you didn't exceed the speed limit by more than 24 miles per hour. I happened to be going quite a bit more than that. I'm going to appear in court to see if there's any way to get out of it. I remember a long time ago that there was a thread on getting out of a ticket. Something about asking when the last time the police officer had his radar checked or something like that. So anyone got any tips on the right things to say when appearing in court to try and get out of a ticket? Unfortunately I was going 32 miles over the limit. Any help would be very appreciated. If it was 5mph over the limit, you could question the calibration of the equipment. But 32mph over? Suck it up and pay. Trust me, you can't fight it. I've been caught speeding much more over the limit than that, and I've never gotten out of paying the extraordinary fine.
Haha man. I don't mind paying the ticket which is pretty bad, but the insurance rates will skyrocket. That's the thing I'm trying to avoid.
I think deferred adjudication would be the way to go? Don't violate another traffic law for 3 months and you get out of it after paying...160 or something.
if you can do deffered judification(sp) youre insurance wont go up. if it says you cant do defensive driving or deffered judification if youre goin over 24mph, still try to ask the judge to let you and tell him you didnt think you were going that fast. good luck.
i got a ticket in baytown for going 70 in a 40 last october(it was the end of the the month and hundreds got pulled over for the same thing) and everyone told me there was no way out of it so i paid the ticket but my insurance wanted me to pay $3000 for full coverage for six months!!!! so i went to auto insurance discounters and am now paying $365 for full coverage, so i actually came out on top cause before the ticket my ins was already $1300 for 6months full coverage. Hope things turn out as well as they did for me
If you're going to speed like that and not have a radar detector and a Bearcat scanner, you deserve to pay the fine. Either slow down or take proper precautions. Bearcat Scanner BCT7- I have one in my truck and my Porsche. It has an automatic alarm that sounds whenever the radio repeaters (used because their radios are LOS) in the trunks of cop cars are used within 3 miles. Valentine One- Only radar detector with the locator arrows and bogey counter, which lets you know how many hostile emitters there are out on the road. It is expensive, but worth every damned penny. The only thing I wish I had was a HARM missile to take those emitters out! I've got your speeding fine.....right here.
Hire a lawyer. I used to autocross, and knew of guys who amassed several speeding tickets, but none ever counted against their insurance.
I have a functioning radar detector in the car. Funny thing is, it was working all night and going off randomly, but when I actually needed it, it was totally silent.
Here's a thought...if you are concerned about the consequences...don't speed. I can see 10 to 15 miles over...but 32???!!! If you were in a heavily populated area, consider yourself lucky that you didn't hurt anybody.
I was coming back from a long trip, and believe me when I tell you I was out in the middle of nowhere. It was an open road, out in the country of Texas. It was around 12 A.M. probably, and there weren't any cars around really.
I got away with going 95+ in a 65 (late at night out in the middle of nowhere), and I consider myself INCREDIBLY lucky that not only did the cop NOT give me the ticket, but he didn't haul me off for reckless endangerment and all the other things I deserved to have been charged with. Do what I did: Consider yourself seriously lucky, and just chill out. Outside of deferred adjudication, you kind of deserve to pay...
But was it a V-1? Comparing other detectors to the V-1 is like comparing biplanes to the F-22 Raptor fighter plane. There is no comparison. I guess you'll have to pony up the money and live and learn.
I'm not sure if deferred is available for 32 over the limit...check and see though. Somebody mentioned questioning the calibration of the radar equipment. Don't bother. The officer will testify it is externally calibrated before every shift and internally calibrated after every traffic stop. Alot of times judges will give you a break on the particular speed and reduce the fine somewhat...also bringing the speed down into the realm where defensive driving and/or deferred adjudication is available. In a sense having you plead to the 'lesser included' of, say, 15mph over instead of 30mph over. Either way, it's worth a phone call to find out. Good luck.
I've known people who've had tickets like this, gone to the court date and they allowed them to take defensive driving.
Has anybody noticed an increase in cops pulling over cars for traffic violations over the past week? I'm on the road a lot as a travelling musician and I've definitely noticed an increase, and unfortunately I was one who got a ticket too. I hadn't had one before that for like 7 years because I don' t reallly speed much. I just got caught in a spot where the speed limit went down and I wasn't paying the attention that I should. Is there any kind of crackdown going on the past week that I haven't heard about?
A couple of my friends have hired lawyers to take care of the speeding ticket. Sure the lawyer might cost some money but you'll end up saving more. I don't know what the exact process is as I haven't done it myself, but look into it.
