I sold an item on ebay. In the main description i wrote its used. but below i accidently wrote brand new. this user bought it and he's saying that its not brand new and i said brand new in one place and used at other. he says hes gonna file a claim at the local court here and report me and stuff.. am i gonna be in trouble or no? i dont have the money to refund it to him. it was a pretty expensive item. i mean i told him he could have asked me before bidding on it.. but he says i talked to my attorney he says i should not talk to you anymore, i'll see you at the court.. what can i do? please help
^^^hahaa but on a real it seems like you'll should be able to do some kind of exchange with the item and the price he paid for it to avoid court....
never mind ignore my first post.....looks like you might have to go to court homie.......have you tried contacting the attorney?
yeah he wants full refund.. but i used up the money to pay my credit card bills.. now i dont have anything to pay for it.. ahhhh im confused!
alright i think i'll do that. ima borrow some money from my friends, that will atleast be an interest free loan
dude, then charge in on the credit card again and it will be like you traveled in time, go back to point 0 .. just don't go to court, it's not fun I'm telling ya..you will end up paying the refund, and a whole lot more in legal costs..
crime, Can't you resolve this using Square Trade (I think that is the name). It was (and may still be) the service that eBay recommends users to use when there are disputes about things like this.
yeah i think i'll do this, but he's not responding to my emails now. seems he's adamant about going to the court. is it worth going to the court for him or no? doesnt he have to pay legal costs and stuff for it?
Well not knowing what you sold him, I would still think that no, it is not worth going to the court. He is probably just trying to scare you. He would have to pay his own legal costs unless he wins the case against you and tries to get the court to have you pay for his legal costs (but I might be wrong on that). EDIT - never mind, I see in an earlier post that it was a Nokia cell phone. Guess it would help to read every post in the thread, Manny...D'oh.
