Ebay Fraud - Which Option

    So here's the story...

    I recently bought a Soccer jersey on Ebay for a pretty decent amount as a collector's item. It was advertised as "player issue match worn" jersey. It has the players name number and everything. The auction said there was a very small defect on the bottom of the shirt and provided picture. The seller rated the overall condition of the shirt as 9/10.

    Seller also said that all of his shirts are authentic shirts and he has been collecting these shirts for past 10 years. When I asked him where he got the shirt from, he said he resides in US but he has contacts in Spain and they send it over to him.

    When I received the shirt, I noticed

    a) Not one but two defects of the same kind on the bottom at different locations.

    b) Several gray spots on the back of the sleeves.

    c) loose threads in 3 separate locations.

    d) ...and what was really disappointing was the quality of the shirt. I have several authentic soccer jerseys purchsed from soccer.com and some from ebay and this obne just did not compare quality wise.

    At this point I got suspicious and started to look at seller's feedback rating which lets me view items he has received feedbacks on.

    I found an item which he won a few weeks ago. The jersey was sold from a seller in Poland for a very cheap price. That seller actually posted pics of the gray spots on the sleeves which this shirt has but the shirt was missing the player name and number!

    So basically, this guy bought a cheap shirt, put on the number and name himself and then sold it as 'match worn player issue" shirt and did not fully disclose all the defects it has. I also noticed that he is selling a few other shirts of different players with similar descriptions.

    So here's my question:

    1) Should I even bother contacting the seller and try to resolve it with him? I am not sure this method will stop him from cheating other people though.

    2) Or do I straight away open up a complaint with Ebay/Paypal and also provide them with both auctions/pics/lies/proof letting them know that he has several fraudulent auctions going on?

    3) Or should I just contact my credit card and open a fraud case with them?

    Paypal & Ebay will not do ****, in my experience.

    Regardless, you should probably do 1, 2 & 3...

    All of the above. It's always better to try everything ASAP, since time is important. Ebay and your bank should have limits on how long you can wait to make a report. The seller can also use it against you, if you decide not to contact him first.

    Contact ebay and your bank, let him know you've done this, but still give him time to issue a refund. The complains take time to resolves, so you have time to cancel them, if he gives you a refund. Just make sure to give him a deadline, like 5 days to respond, a week to actually issue the refund, etc...

    I did this for someone who kept saying they shipped the item and yet it kept getting "lost". However, it helped to find out who he was and where he was at. I threatened to contact his local PD and inform his employer of his dishonesty and I quickly got my refund. Google his ID, email, anything you can get on the guy and go from there.

    I just realized that right after the auction had ended, this guy had messaged me on ebay giving me his email address and asking if I could paypal him the payment directly and not through ebay. He said that if payed through ebay, ebay puts a hold on the payment for 30 days.

    Of course, I refused and payed him through ebay so that i would be protected as a buyer.

    The new sellers would sell legit stuff build some rep and then they go on a scamming spree. I'm talking about 30-100 ratings. My cousin bought the Kobe grinch and returned them back all cut up. He still had to pay for shipping like fitty bucks.

    The new ebay policy is:

    You need to contact the seller first to try to settle disputes.

    If he does not respond or does not accept return, then you can file dispute w/ ebay and paypal.

    When you do return it,
    Make sure that you ship it insured and w/ delivery confirmation. Signature is prefered.

    The new ebay policies protect the buyer more than they have in the past. In the past, you are most likely SOL.

    Well then it sounds like you have a case.

    Have you raised the issue with the guy directly?
    You are trying to buy game used jerseys? that seems a little gross unless it's someone legend / big game and you are hanging it on wall

    Ebay requires you to contact seller and try to have it resolved within 30 days if it does not then ebay investigates the claim and either tell you "tuff luck" or they can refund your money. I have recieved money back from ebay/paypal 2 seperate times b/c an item was defect and auction stated 30 day return policy and I returned to seller but seller did not refund money. Another time the item never arrived and the seller would not respond.

    Though I've only done it once, Paypal resolved a dispute I had about a month ago. I got a complete refund.

    I'm still waiting for EBAY / Paypal to release the funds from a recent sell of mine. They already want me to pay them $21 for fees....and yet, won't release my money till Nov. 11? WTF.

    He is a legend. One of the best players to ever play the game. And yes, it would be part of my collection.

    The seller has responded and asked me to return the item and he would refund me. I will be sending the jersey back to him on Monday. He also asked nicely not to leave a negative feedback because he is a student and relies on ebay as source of income. I have decided that as long as he refunds me right away once he gets his jersey back, I will close the case and and will not leave him a feedback.

    Wait for the refund and then file the complaint and leave negative rep, otherwise many people will go through the same ish and he'll gladly collect the $ and not give a F. It's okay to have an income per ebay, but not if you cheat your customers. He's only being nice to you so that he can continue with his "business".

    You should still leave negative feedback. It is basically the only way to screen a seller's credibility, and what he did was so blatantly fraudulent, don't you think other bidders deserve to know what they are getting into?

    Gotta agree on the neg rep. And, I would complain to ebay too. Maybe file a complaint with the police. It isn't simply that it wasn't in as good condition as he had led you to believe. You think he actually committed a fraud. If the worst thing that happens to him is a bad ebay reputation, he got off lightly.

    Just echoing what others have said. Neg rep the **** out of him. There are countless other ways to legally and respectfully earn $ for college.

    But good for you that you're willing to forgive and forget.

    I have to say I was impressed by ebay's cs response.

    Within 1 day of opening a case, they emailed me asking me to return the item. Ebay even provided me with a pre-paid UPS label to ship the item which they can track. Once the tracking shows that the package has arrived at the seller's location, ebay said they would refund me full $$ if the seller hasnt done so within 3 days.

    I guess the one page essay I wrote to them while also including the pictures as proof convinced them.
