Do Not Call List and Independent Contractors

    At an agency meeting this morning, some new aspects of the Do Not Call legislation were discussed.

    If you are an independent contractor and have not made a new sale to "your client" in the past 18 months, you are in violation of the DNC law if you contact them. It doesn't matter if the person has been your client for 22 years and you've called them 150 times in those 22 years; if there is no new sale (ongoing payments in the insurance business, for example, do not count as a new transaction) in the past 18 months, you can be subjected to an $11,000 fine.

    Realistically, your clients are probably not going to turn you in, but some lawyers got involved and this is the new interpretation.

    Check with your company. We have a new permission form that we are urged to get every new prospective client to sign which gives up tacit permission to call or email them.
