Do I Have A Case For A Law Suit? Serious Advice Please

    Ok well let me tell you guys what happened. In early march, I was at work (memorial city mall security), and the bike that I was riding chain came off and I fell and fukd up my left knee pretty bad. They sent me a company dr, the company dr refused to do any X rays and MRI's, said it was a waste of money and I was to return back to work asap. Never even talked to me, my boss said I never had a chance to see any other dr, and If i tried to see another DR he would fire me. Well i returned back to work and my knee got worst the day I returned, and I hired a Workers Comp Lawyer and they sent me a real dr and im currently on workers comp and will be until july 13th.

    Well i was talking to a couple of close friends, and they said I should try to get a lawyer and try to go after my work for neglect and bs. I reported the injury on a Sunday and they never sent me a Dr until Monday, even thou I told them how bad it was and I was in deep pain. Also they refused my right to see any workers comp dr, also I had reported the bike numerous times before as it was giving me lots of troubles in the past. Also im not the first one who fell off the bike, they have a record of employees getting hurt while riding, so they dont really take care of their equipment.

    So what do you guys think? Should I at least call a lawyer on monday and explain my situation and see what he says?

    is the bike company issued?

    if so, yeah definitely go ahead and sue. get one of those lawyers u see on tv all the time, like jim adler.

    yup its company issued, they've had like 6 injuries in the past year, two guys had to go to the hospital, they dont take care of their bikes and they know it.

    And ya my friend told me to call jim adler and tell him the case.

    If you don't have to pay any attorney fees, I don't see any harm in contacting a lawyer. Only thing is you won't have a job at Memorial City Mall Security anymore.

    Well my current lawyer takes 25% of w/e i make from workers comp, and Im pretty sure Jim Adler takes commission too, so thats excellent. And ya true I wont have a job there but Ill find a job some where else.

    I may be wrong but if I'm pretty sure if you currently have workers comp insurance you may not be able to sue the regular way in court. You'd have to go through the insurance company to get fully compensated.

    well im already getting my pay from my job for the time i missed, but I wanna sue for more also.

    Is this really worthy of a law suit?

    I guess it's your call, but you are getting paid until you return to work and your medical care is being paid. Are you really suffering that much from an injured knee?

    Obviously I have no idea...can only go by what I read

    That's my point. The rules of the workers comp most likely will bar you from being able to sue directly (although the conditions may vary from place to place). That's why they have workers comp funds...so the system isn't bogged down with lawsuits.

    well i know lots of ppl that are both on workers comp and filed a sep. law suit..

    well it was the ****ty way they treated me, didnt let me see another dr, treated me like I was a no body that really pissed me off.

    If you were in pain, why would let some a$$hole at your work tell you not to see a doctor and let them say they will fine you!

    I'd have gone off my head. Lost my job.....but still would have gone off my head! :D

    I would advise never litigating out of anger.

    If you are totally calm, with no anger in the decision, and it seems like the right thing to do, then go for it.

    Unless you have a serious long-term knee problem now, what I'd expect is that you're going to pay a lawyer a lot of money and not see any big reward in court.

    But we have actual lawyers here (not me) to field this call!

    If they're doing this to you, they're doing this to everyone else who gets hurt on the job. Just because you actually went to another doctor and got things taken care of doesn't mean everyone else has. If they're threatening to fire you if you go to a doctor, it seems to me that would be against the law and something should be done about it.
