Thomas' case was different, because the NCAA ruled him ineligible as a freshman based on a class as a ninth grader. Thomas won the temporary, and then a permanent injunction, in an Albuquerque court. The NCAA, Thomas and New Mexico settled the suit in the spring of '96 after playing his entire freshman year and leading the Lobos to the NCAA Tournament. Under article 19.8 in the NCAA rules, the Lobos were subject to penalty if they used a player who became eligible through the courts. Thomas' legal fees were paid, and he agreed to sit out his first semester of his senior year in a deal cut among the three parties. New Mexico also took a scholarship hit. "You've got to prepare to know that your season is in a judge's hands," said Thomas, now a second-year forward with the Houston Rockets. "It's a wild way. But a court system is higher than the NCAA. The judge will decide if he can play, not the NCAA. It's worth it. If he's good enough to play in the NBA, then he should take them to court." Did anyone ever post this before?
