I recently posted about my speeding ticket being defective. The One Call Solution rep told me that my ticket was defective and that I did not have to show up for court. Since I was paranoid, I called the tonight (the night before my court date on the ticket), and this time a different rep told me that I do need to show up for court. They see that it is a defective ticket, but they're telling me to still show up for the court date. What does this mean? Will the judge throw my ticket out because it's "defective" in the system? Or will he/she say, just because there is no day in the offense date does not mean you shouldn't be punished? I'm a bit upset about the whole thing
I will. What do judges usually do when a ticket is deemed defective in the system? Does the judge see that, or do I have to tell the judge that I was told the ticket is defective?
I just called again to confirm the reason for the ticket being defective. This lady put me on hold, came back and said that she spoke to her supervisor. I do NOT have to show to court because the ticket is defective and with the legal department. If I don't feel comfortable, I can go to the court to get a defendant's appearance receipt. What the..
Didn't you speed? What is wrong with the "defective" ticket again? Wasn't it some misinterpretation of personal info? All this headache and worrying about it... If the above is all true, and you can't be sure, show up and be ready to pay the fine. If you don't have to pay in the end, great.
Just go man, why risk it? I mean if you are this paranoid is there really any valuable advice anyone can give you here that will make you not go? At the end just go to court get the ticket dismissed and be glad that you don't have to second guess yourself if you didn't make the wrong choice.
I would go. Unless you can get it in legal documentation (letter, e-mail, signature, etc.) or have the clerk's names, you have no claim as to why you didn't show up if it was required.
I once got a defective ticket too. The cop messed up my social # by one number, and I still went all the way to court! When I got there, they told me there was no case against me because the ticket was defective. It was a waste of time (parking, lines) but at least I didn't have to pay anything!
When a ticket is defective due to a mistake done by the officer who wrote it up, does the officer in the wrong get a punishment of some kind? A reminder? Slap on the wrist? Face? My friend got a ticket and the officer didn't write his full first name out.. and I think he still had to go to court and the ticket was still valid.
Don't know about any punishment. I think what makes a ticket defective depends on what part of the ticket is wrong. Even if he didn't write his name right, he might have gotten his DL and Social right. In my case, he got my social wrong.
I've also seen tickets where an officer has sloppy handwriting and you can't read anything on the ticket.
On Court Day: Judge: Why do you think you are innocent? clutch citizen: Sir, the ticket is defective. Judge: What do you mean it is defective? clutch citizen: Sir, the ticket is broke. Judge: /facepalm/
I'm going. I had scheduled deliveries for utilities and appliances for my new home after work today, but I re-scheduled I called 2 weeks after my ticket to submit my DSC application, then they told me to wait because it's still in the legal department. I call a week later, and the rep tells me that my ticket is defective because he's missing the day in the offense date. The rep told me I do not have to go to court. I call again last night, the rep tells me I do need to go. I called one more time to confirm, and the rep says yes. Then I called again to confirm why the ticket is defective so I can present it to the judge. That rep says I do not have to go to court because my ticket is defective and has gone through the legal department
