Cop illegally stops law student carrying gun and gets hammered with knowledge

    I understand that the video is a potential breach of the 4th amendment, but if I saw someone walking around with a gun showing on a busy street, I would probably be alarmed as well.

    I know that it's not unlawful to openly carry a gun, however, I think the guy should have more common sense. I don't think the cop did anything wrong by responding to civilian reports/merely asking for his license. Yet, I would be ridiculously pissed if I was unreasonably searched also... Just wondering what y'alls takes would be on this video/subject.

    The kid's a douche, but there has to be a better way to do this. I understand there's a balancing of rights issue and the cop would be legally wrong and the kid legally right...but damn, is this the way we should be in society? I think the concealed hand gun laws in Texas make much more sense. I don't think the cop was trying to harass the kid on his own volition.

    I love guns, and this law student is obviously super intelligent, but he is also a complete ass . . .

    So you are legally allowed to walk down a public street with a loaded hand gun???

    If he didn't do what he did he probably would have had his gun confiscated and would have ended up in jail.

    Not really. The supervisor in charge knew what he was doing. This is just a case of a misinformed police officer not well-versed with the gun laws in Maine.
    Although I really disagree with the ability to openly wave a loaded gun around in public. Concealed carry would not jeopardize his security and it would prevent incidents like this from happening.

    I don't have any issue whatsoever with what the officer did, or the student - to me this is a complete success story of our system.

    Feels like this law student was hoping to get stopped (and the "foresight" to record the entire event).

    Basically he was trolling the police officer. If the initial police call stated that the gun was openly out of the holster, there would be cause for a stop because that would indicate a threat to the public and the suspicion of assault to anyone around him.

    Probable Cause. I wonder if the law student is aware that the police are not the District Attorney, or how much of a douche he is.

    It's federal law. not just a state law. This is what we call here in America...LIBERTY.

    The cop DID harass the kid, period. If no crime was committed, which the officer states wasn't. He had no probable cause to justify a " check " of any sorts. This isn't Mafia State Russia, and American's to have the right to carry....WITHOUT providing permits/ID/Certifications to a Peace Officer.

    so you are saying right now I have no permit for firearms. I can go find a gun and just waive it around and police officer cannot legally ask me if i have the proper papers/id to have the gun?

    The second amendment doesn't allow you to do whatever you want with your guns whenever you feel like it. From District of Columbia v. Heller
    EDIT: Besides, there is no federal open-carry law. It varies from state to state.

    This is a great example of several issues I have with law enforcement.

    -They are ignorant of the laws they enforce.
    -If they aren't ignorant of them, they rely on the ignorance of the common man to lie about the laws to get their way.
    -They typically try to bully or cajole people if their pseudo law talk doesn't work.

    This is precisely why I would like to go to law school. Cops are out of control. They have little or no oversight and the blue line hampers due process when they are accused of wrongdoing. This is why every cop should wear a camera that records every second of what they do. Every bit of this data should be accessible by court. They are to be held to a higher standard and should be penalized for every instance of inappropriate behavior.

    I'm not saying that the cop was legally right, but the cop wasn't being a douche bag or nearly as douchy as other cops have been or as the kid was acting. Everything else is a good debate, but I'm strictly referring to attitudes. The cop was ignorant, trying to be authoritative, trying to do his job, and legally wrong, but he wasn't the douche in the situation.
