Car Accident Rant….

    So last night I’m watching the Thursday Night game witnessing my $200 on Mia +3 go down the drain when I get a call from my GF. She had left the apt a few minutes earlier to go pick a pizza from HEB for us to dine on. She’s crying hysterical and asks that I come to the street in front of our apartment to get her. I get there and I see her car crushed from behind by another vehicle. She left the apt driveway and turned left into the street. She said she saw a vehicle coming from far away but did not gage how fast he was coming….anyways that guy rear ended her into the sidewalk and into a wooden power line pole. Fortunately, she didn’t hit the power pole head own (instead on the passenger side) and no pedestrians where walking their dogs at the time. Common occurrence where we live. Bering between San Felipe and Westheimer. Anyways, she’s going to be fine. She did suffer from whiplash and her body is very sore today. But the reason I’m ranting is the douche fled the scene. He abandoned his car. Problem is we know where he works. Zoey’s kitchen cause he was wearing the shirt. His car was full of Zoey’s Kitchen paperwork.

    Apparently, he didn’t have insurance and I suspect he didn’t have his papers (illegal alien). Its douches like this that give 99% of good illegals a bad rap.

    Can we hold Zoey's Liable if it turns out they hired an illegal?

    Zoey's off of Washington? I drive by there on the way home from work. Want me to scout? I'm good at making a scene.

    What an idiot (The Zoes guy). Only other reason he fled is that he could have been drunk. Now there is no way to charge him with a DWI but only a fleeing the scene charge. Its bull****

    Fleeing the scene of an accident is a felony. I'm serious about going to Zoey's to to talk to the manager. What kind of car was it? I get take out at least once a week there and I know the front desk people pretty well.

    Glad your GF is ok, DS, but I'm guessing if he abadoned the car you can absolutely track this guy down.

    It happened @ 10pm last night. I do believe they will be following up @ his place of employment and tracking the car to the owner.

    This Zoey's is off of San Felipe & Bering Drive. His car was a 2004 Maron Chevy Monte Carlo. Police impounded it. I appreciate the offer but at this point I don’t want to bother the folks at Zoey’s until we receive legal consul on what (if any) liability Zoey’s may have for hiring an illegal that commits a felony and is unable to pay for the damages he’s caused.

    Don't think he was drunk. My girl believes he mus have been texting to hit her like that at full speed.

    If the cops had showed up within 20 minutes we would have been cool. But they took 40 minutes from my first call to arrive at the scene. The dude bounced out after about 25 minutes. I followed him down to westhimer while i called 911 to ask for advice but they said as long as his vehicle had a license plate i didn't need to follow him.:eek:

    Interestingly, based on what your girlfriend said (she misjudged his speed), he could probably make a case that it was her fault for turning in front of him. That being the case, there must have been something else going on for him to have fled like that.

    Don't assume things, man. How did you know he didn't have insurance until you ask him?

    This is all a good assessment. :eek:

    I hope your girlfriend is well and gets the car fixed by her insurance. Does she have full coverage?

    He said he didn't have insurance to me. He didn't speak english. And my GF (in her frantic state) believes he told her before i got there that he was illegal. Bro why you mad? I'm Brazilian (my girl is columbian) and know plenty of good illegal's that wouldn't do the same.

    He sounds like he could also be Russian.

    Does your girl have uninsured motorist? PIP on the policy? She should make a call to her agent and get advice there as well.

    I thought about that too. But looking at the scene of the accident he hit her at full speed directly behind her. I discussed with the police and they agreed it was the other drivers fault based on scene.

    Additionally, there are multiple apt complexes on Bering drive and it’s an everyday thing to turn into traffic with cars heading at you from both directions. So while I understand where you’re coming from she didn’t get sideswiped on the passenger side of the vehicle. It was a direct hit to the back of the vehicle.

    Also, i'll need to check but i believe the speed limit is 35 on that part of bering. The damage he caused he had to be going 50.

    Funny, my wife got sideswiped by some Chinese guy off Bellaire and the Beltway last night and he fled the scene, so we're pretty much ****ed as well.

    That's my question. Shouldn’t employers be held accountable for harboring undocumented workers? They provide the incentive for him to be in the USA & the means for this man to be on the road.

    If a bar get a guy drunk and he crashes into someone...The bar has liability. What's the difference here?
