Car Accident Question

    So I just accidentally backed out of a parking spot into someone who was parked in a handicap spot. They were in the car when I hit it.

    There was no visible damage done, and i handed the woman my cell phone number if she needed to contact me.

    But I noticed that she did not have a handicap mark on her license plate or front window.

    If she does find internal damage am I still liable since she was illegally parked in a handicap spot ?

    Haha... I wonder why she didn't a cop to come and file a police report? Perhaps because she was parked illegally?

    Hope you took a picture with your cell phone. In the very least, you can't be a pain about it.

    Liability has more to do with negligence. IOW, even if she was parked illegally, if you backed into her while she was parked, you are at fault.

    But if she was parking legally which isn't in a handicap spot then I wouldn't of hit her.

    I don't think anything is going to happen from this but I was just curious.

    Was there a handicap post sign? Or was the handicap symbol just painted on the ground?

    You dont need a handicap mark on your license plate. That's usually for people who are permanently handicapped in some way. When I was on crutches I had a little tag that hung off the mirror above the dashboard.

    I think you still need a pass on your dashboard in order to park in handicap spots.

    Since she was still in the car, perhaps she hadn't put her tag on yet. Aren't you NOT supposed to drive in Texas with the tag hanging down and you only put it on prior to getting out of the car?

    Hell, I don't know what the rules are for handicap. I just know I always see that tag up there whenever the car is parked.

    I am fairly certain my mother-in-law can only hang her tag once the car is parked.

    She wasn't just sitting in the car about to park, she was waiting there to pick someone up from the front of the building.

    Also I used to forget to put up my tag a lot.

    Doesn't matter one bit. Her being parked illegally gives you no legal right to hit her vehicle with yours.
