Can my boss deduct pay with out consent?

    My boss wrote up my fellow co-worker for insubordination and for being late ok thats understandable but heres the catch he also wrote he will be deducting .50 from his pay of 11hr to 10.50 my co-worker did not give them consent to and wrote that on the write up that he does not acknowledge the pay decrease. Now here i found this on TX DOL this section referencing it. Am i interpreting it right. what can he do once he see's the deduction from his pay? And they did this to 3 of my co-workers one in which they stated a 2.00 decrease. He is an older asian guy and didnt want to get fired so he signed it.

    Sec. 61.018. DEDUCTION FROM WAGES. An employer may not withhold or divert any part of an employee's wages unless the employer:
    (1) is ordered to do so by a court of competent jurisdiction;
    (2) is authorized to do so by state or federal law; or
    (3) has written authorization from the employee to deduct part of the wages for a lawful purpose.

    Is it a deduction or a cut in salary/wages? Clearly he can not deduct from his wages.

    humm i would say he is cutting/reducing his pay from 11 hr to 10.50 hr

    What about rule 2? Is it authorized under law?

    The company can reduce your pay at their discretion unless you have a union backing you.

    He can reduce his pay from say $11/hr to $10.50/hr without consent... but thats only for future use. Your boss can not legally deduct pay for the hours already worked. He has to pay $11 for those. But if he says starting next week I'm reducing your pay to $10.50/hr.. There is nothing wrong with that.

    Employment at will. The boss can do what he likes.

    Your boss may have the right to deduct your pay, but remember,

    You have the right not to cash that check.

    Thanks for including this crucial piece of information.

    As others have already stated, cutting someone's pay is different from deducting from a paycheck.
