Man assaulted trying to uproot mar1juana plant

SAN LEON — A man prepared to uproot a 78-inch tall mar1juana plant in front of his mobile home was assaulted Friday by his daughter’s knife-wielding boyfriend, authorities said.

Bond for Anthony Jose Padilla, 23, was set at $12,000 on charges of aggravated assault with a deadly weapon and felony mar1juana possession, Maj. Ray Tuttoilmondo, a Galveston County Sheriff’s Office spokesman, said.

Ruben Cuellar owns two mobile homes in the 900 block of Paulett Street in San Leon. He lives in one, and his daughter and her boyfriend reside in the other, Tuttoilmondo said.

“The man told them to get rid of the plant, and apparently that never happened,” Tuttoilmondo said.

Cuellar, with shovel in hand, prepared to uproot the plant that was growing between slats in the wooden front porch and through a wire dog kennel, Tuttoilmondo said.

“He was confronted by his daughter’s boyfriend, who was armed with two kitchen knives, and he basically said, ‘Touch the plant, and I’m going to kill you,” Tuttoilmondo said.

Cuellar swung the shovel, striking Padilla in the legs and causing him to drop the knives, Tuttoilmondo said. At some point, Cuellar dialed 911, and dispatchers have an audio recording of the scuffle that ensued, Tuttoilmondo said.

Padilla, who stands 6 feet 2 inches tall, came after Cuellar, who is 5 feet 5 inches, and started hitting him, Tuttoilmondo said. The men scuffled and went to the ground, he said.

Deputies arrested Padilla nearby and seized the 61/2-foot tall plant, which will be submitted for laboratory analysis, Tuttoilmondo said.
