from this article Transplant girl, 17, dies

"The Santillan family declined to donate any organs from Jesica's body, Puff said."

this girl gets 2 sets of transplants, dies, then her family refuses to donate any of her organs to someone else who may need them?

    that's gratitude for ya!

to top it off... they aren't even paying for any medical bills!

"Renee McCormick, a spokeswoman for a charity created to pay Jesica's medical bills"

I bet their attorney's are seeing dollar signs swirling down the commode with that decision.

The family shouldn't pay for any medical bills since the hospital's botched transplant killed the girl.

I think it's very greedy of the family not to donate her organs to save someone else's life. Of course, I'm not in their position so I cannot understand their thinking right now.

I can see how they might be somewhat upset right now, considering the death of their daughter, and not feeling all that charitable.

Not being a doctor, how would good were her organs have been? I know she had a lung/heart transplant, but how does that affect the rest of the body.

Oh, and I have no problem with them not paying their medical bills if a charity wants to. However, I'm pretty sure even the charity shouldn't have to pay at this point.

But wouldn't that still be highly hypocritical?

They are not donating her organs b/c they are demanding an autopsy. If the organs are taken, then all the tests cannot be done. I did not read the story you had there, but its also important to point out that the Dr's in this case took her off life support without the family's permission, but in NC in certain cases they do not need family permission.

I do find it quite odd that in such a high profile case they exercised that right (for the lack of a better term), especially when they screwed up so bad to start with. At the press conference, the main Dr said he took full responsibility for what happened, and there is no one else on that entire team or at the hospital that had anything to do with this. It was rather strange, but he certainly looked shook up.

I think it was a horrible mistake that led to the death of this young girl. But then the question arises, should a family that I believe is here illegally and that did not pay a penny for the procedures be allowed to sue??

So, if an illegal immigrant is beat up by legal residents, there should be no recourse?

Sueing doesn't mean winning. Everyone has a right to be heard. If she wins she had to make it thru a grand jury and a jury of her peers. People who win their cases generally deserve to win.

The family should be able to sue but after they win they should be deported.

The attourney was on TV this morning (of course). He said that it had been decided, and discussed with the physicians, several days before the girl's death, that if she were to die the family wanted an autopsy. He pointed out that the staff at the hospital knew (or should have known) this, and it was insensitive of them to bring the subject up with the family.

There are organs & tissue that could have been donated, assuming the autopsy had not already been requested. However, the appropriate time to ask this would have been before she was taken off of life support -- not after -- when the clock had started ticking.

Well, they probably figured that the hospital would put her donated organs in the wrong people anyways, so they're saving the hospital the time and money of harvesting them...

This is a prime example of why we need tort reform. Yeah, that's the ticket.

FYI -- on the radio today they brought up a subject that someone here had mentioned -- this botched transplant killed at least 2 people, the girl and the person (or persons) who didn't get the first set of organs. It may also kill others, as organ donation centers are already experiencing a backlash of those unwilling to donate.

    It's very sad.
