If they're running back across the border, why is he still chasing them? This video certainly does not jive with the story the agent and spokespeople for the Border Patrol and FBI of been giving us.

Questions over U.S. Border Patrol agent's fatal shooting of Mexican teen raised by new video

A new video has surfaced raising serious questions about the fatal shooting Monday of a 14-year-old boy by a U.S. Border Patrol agent.

The grainy cell phone video, shot by a witness on the Mexican border, was first aired by Univision late Wednesday.

The footage seems to contradict statements made by the agent who shot and killed secondary school student Sergio Adrian Hernandez Guereca in Ciudad Juarez. The agent has claimed he was surrounded and attacked by a group of rock-throwing illegal immigrants, prompting him to use lethal force.

But the video, also obtained by CNN, shows a seemingly different lead-up to the incident. In it, a U.S. border patrol officer can be seen approaching two of the four suspected illegal immigrants who had just crossed through an opening in the fence, stopping one of the suspects, and then dragging him a short distance, CNN reported.

The officer then appears to aim a firearm towards the second suspect, standing on the Mexican side of the border, who is then seen running away. Just moments later two gunshots can be heard, and a third gunshot is heard later on the tape.

"They're throwing rocks," voices can be heard screaming in Spanish as the agent fires the shots. "They hit him ... they hit him."

"The young man was not armed," said Sergio Belmonte, Ciudad Juarez spokesman, who says Hernandez was shot in the head. "The aggression (by the U.S. agent) is evident."

Customs and Border Protection agents have said the incident was prompted by their investigation into reports that a group of illegal immigrants were being smuggled into the U.S., according to FBI special agent Andrea Simmons.

Simmons said, "This agent, who had the second subject detained on the ground, gave verbal commands to the remaining subjects to stop and retreat. However, the subjects surrounded the agent and continued to throw rocks at him. The agent then fired his service weapon several times, striking one subject who later died."

Simmons told CNN earlier that she did not know whether the person who was shot was on the Mexican or U.S. side of the border, but that the agent never left U.S. territory. She did confirm that the body was found on the Mexican side of the border.

Mexican leaders on Wednesday condemned the shooting as U.S. officials launched an investigation into the circumstances of the second killing of a Mexican by a U.S. agent in two weeks.

"The growing frequency of this type of event reflects a worrisome increment in the use of excessive force on the part of some border authorities," said the Mexican foreign ministry.

Mark Qualia, a spokesman for U.S. Customs and Border Protection, said lethal force is permissible "when an agent is in imminent threat of physical or bodily harm, which could cause death or injury or in protection of an innocent third party," reported CNN.

The determination to use lethal force, Qualia said, is made by the agent at the scene. He did note that rock-throwing can pose a serious threat, saying: "They're not chunking pebbles."[show us these deadly rocks, maybe show us pictures of a wound the border agent received from said deadly rocks -oski]

Perhaps the same could be said of all law enforcement personnel.

Well I wonder how the US Border Patrol will spin this, since they were caught by video?? How often does this happen with palestinians kids throwing rocks at Israeli soldiers???
