    I guess this sort of falls under the $4.99 thread and the Blacks in Restaurants thread category. I think these ladies overreacted, but you never know. Its really hard to choose a side.

    NEW YORK (Reuters) - Two black shoppers have sued Toys "R" Us saying they were subjected to racial discrimination and unjustified scrutiny at a store in New York.

    Patricia Drayton and Valerie Kirk said in the lawsuit that the store in The Bronx, a borough of New York City, discriminated against them by asking them to show their sales receipts. The suit was filed in Manhattan Federal Court on Tuesday.

    Drayton said in the lawsuit that she was stopped by a security guard at the door of the store and asked to show her receipt. After refusing to do so, she was made to wait while the employee checked with a cashier to see if she had purchased the merchandise, the lawsuit said.

    According to court documents, Kirk was told by a man working at the story that Toys "R" Us's policy required that she show her receipt to him prior to leaving the story. Kirk said in the suit that she refused to comply and was banned from shopping there.

    The lawsuit said black shoppers are subjected to compulsory inspection of their sales receipts while white shoppers are not.

    The women are asking the court to give the suit class action status to represent all black shoppers who have been subjected to the same procedures by Toys "R" Us.

    Metro One, which provides loss prevention services to retail stores, and several people employed by the two companies are also being sued by the women.

    They are seeking compensatory and punitive damages of at least $200 million each on behalf of the class.

    Representatives for Toys "R" Us and Metro One were not available for comment.

    Toys "R" Us, the country's second-largest toy retailer, is owned by a consortium that includes Bain Capital Partners LLC, Kohlberg Kravis Roberts & Co. and Vornado Realty Trust.

    The company still reports its financial performance because some of its bonds are publicly traded.

    they ask everyone to show their receipt. i dont mean to trivialize their complaints cuz i'm sure theres racism involved a bit, but far as I know, anyone is subject to receipt checks specially if the store is in a high crime area or they've had a stroing of recent shoplifters.

    Show em the receipt. How hard is that?

    I'm black and when I was at U of H, I was buying something at the 24 hour snack shop when a campus cop walked in. I was in the back row and I had a big trenchcoat on with some big pockets, and I already had grabbed a couple of things and was holding them to my side, near my big pockets, when the cop walked into my row, caught my eye and kind of squinted. Then a little bit later, when I walked to the counter, I saw the cop kind of dart out to the left of the counter, near the store's entrance. Also, anytime I ran into that reasonably attractive female cop on campus, she gave me the squinty-eyes.

    From that day on, any time I'm in a convenience store I never hold any merchandise down on my side, I hold it up in the air, like a microphone or something. Better r****ded-looking than suspicious, I guess.

    Also, any time there's a cop anywhere, I take the initiative to make eye contact and say hi. And anytime anyone asks for anything, they get full compliance, with a big old Bojangles grin.

    There was another time I had just walked out of the library, when a campus cop loudly summoned me, asked for my ID, then his partner asked if I saw a black kid on the second floor with a black backpack, black jeans and "old-timey" clothes in the library "Other than me? no.."

    Then there were the two polite and amusing spot ID checks. Campus cop would ask to see my ID, I would say student ID or driver's license, he'd say either one, then I'd give him my driver's license and then Kojak would ask me if I went to school there. Yeah...would you like to see my student ID?

    Were I an honors student at Rice I might have been offended, but a stone's throw away from Scott Street, dressed like a tired, grumpy hobo, at the alma mater of Wig Shop Killer, I can probably understand their actions. Some of those campus crime reports were terrifying.

    $400 million, embarassing. Their neuroses and stupidity is being exploited by some ambitious, scrupulous and (hopefully) non-black lawyer.

    I remember someone challenged Fry's on their policy, and the company was forced to admit that, unless they have probable cause to suspect that you are shoplifting, they have no legal right to stop you at the door and check your receipt. You are fully within your rights to tell them "No" and walk away.

    What this means is that, unless the store had probable cause to suspect these particular women were shoplifting (and being black doesn't count as probable cause), they're lawsuit might have merit.

    If it's a class action, doesn't that mean that everyone in the class gets a piece of the settlement? Like all black people on Earth? Yeah, the lawsuit is stupid, but if they're suing on behalf of all blacks, then all blacks should benefit, not just them.

    Am i missing something here or did you and the rest of the people saying this just not read the whole article.

    I think the main point here is:

    "The lawsuit said black shoppers are subjected to compulsory inspection of their sales receipts while white shoppers are not."

    While i think the lawsuit is way over the top if the statement above is true then they have a valid beef with Toys.

    Yeah with a class action it's suing in behalf of the class and anyone in that defined class who agrees to be part of the suit would get a share of any damages that may be awarded. I have no idea how the class would be defined but I speculate that it's anyone that is African American that shopped at that particular store during a set time period.
