Anyone familiar w/ Lemon Laws?

    purchsed a 2004 volvo last weekend through an ebay dealership. I won't name them...but lets just say my Auto was purchsed Directly in Texas..
    by Thursday the car stalled out on a quarter tank of gas...as if it was empyu

    turns out the model has a duel gas tank system, and there is a flaw in the engineering of the of transmitter between the tanks...

    the dealer says they have no liability for this as it falls outside the parameters of the limited liability agreement, and is an engineering flaw...not a safety issue...

    do I have any legal recourse for the dealership to pay for this repair? or am I simply SOL?

    I have officially owned this car for a week as of 1 today... :rolleyes:


    fyi: haven't been quoted on the damages yet...anyone had a similar experience who can give me a ball park?

    I think lemon laws are only applicable to used cars if they're still under the original manufacturer's warranty.

    Just read about this earlier today. I hope they take care of this for you. Sucks to have it for a week and already having trouble with it.

    Situation #2:

    When No Manufacturer's Warranty Exists

    If you do not have, or were not provided, a manufacturer's warranty of any kind you may be entitled to compensation for violations of consumer protection laws that fall outside of the scope of Texas Lemon Law. The following is a list of some of the issues which may be present in your automobile.

    ▪Prior mechanical history- Known to the seller: Laundered Lemon.

    ▪Previously salvaged (wrecked).

    ▪Rolled back odometer.

    ▪Rental car, police car, taxi, etc.

    ▪Stripped and rebuilt.

    ▪Flooded.

    I had a feeling that was the case...it fell right outside of the manufactureres original warranty...so no dice there...

    the laundered lemon would be the only one this comes close on...but these guys show the carfax report on all the cars they sell, so I am sure this is their way around it...

    I know for a fact the car had its fuel pump replaced in just Sept...which is most likely why the tank transmitter would start working incorreclty...

    Did you have an mechanic check out the car before you bought it?
