Spoiler Aldon Smith suspected of DUI SAN JOSE, Calif. -- San Francisco 49ers linebacker Aldon Smith was arrested Friday morning on suspicion of driving under the influence in San Jose, police said. Officers arrested Smith after a solo vehicle crash in the city's Silver Creek area, San Jose police Sgt. Heather Randol said. She did not give any additional details. Calls to representatives for the 49ers seeking comment were not immediately returned. Smith has also been named in a lawsuit by a Northern California man who said he was shot during a party at Smith's house. In the suit filed earlier this month in Santa Clara County Superior Court, David Kleczek, an attorney for Ronndale Esporlas, claims that Smith and former Niners tight end Delanie Walker fired weapons illegally during a party at Smith's San Jose home on June 29, 2012. The players charged a $10 admission and $5 per drink, the lawsuit said. Smith, 23, and Walker, who is also named in the suit, were allegedly intoxicated on Smith's balcony when they later fired gunshots in the air while trying to end the party, the lawsuit said. Kleczek said they then moved to the driveway where he alleged more shots were fired. Esporlas, 21, was shot twice in the leg while he was "caught in the crossfire between the two groups of people firing gunshots at each other," the lawsuit said. As a result, Esporlas "sustained serious, catastrophic and permanent injuries," the lawsuit said. The lawsuit seeks unspecified damages. Attorneys for Smith and Walker, 29, have said Esporlas "freely and voluntarily exposed himself to all risks of harm" by attending the party. They say injuries suffered by Esporlas, who was shot in the leg, were not caused by the defendants. Santa Clara County prosecutors have said they are considering criminal charges.
Pay $10 cover to attend an NFL player's house party and expect to get shot? Sounds about right... Not only that, but if saying, "You agree to expose yourself to all kinds of harm by agreeing to attend my party" is really the defense he wants to roll with, maybe a nice big dose of reality is what Smith needs. I believe he was stabbed at the same party, and back then, he said he was firing shots in self-defense. If that's truly the case, why wouldn't you make THAT your defense in a lawsuit? It makes no sense to me.
Wow. Seems as though the 49ers season is toeing the line of coming completely unraveled. I'm sure they'll be ok...but seems as though eeking out a win against the Packers and getting thoroughly prison-shower-scened by the Seahawks is not a good way to start the season. And now this. Maybe some Raiders is rubbing off on them.
There are so many things wrong in this story, it's truly unfathomable for an NFL pro athlete to be caught up in such stupidity. I've got questions, aside from the obvious firearm violations... 1. Was Smith really charging $10 cover to attend his house party? I could be flat wrong, but surely he wouldn't make friends pay to attend, would he? BYOB would make more sense, although even that's rare for an NFL player's house party. (which begs my next question...) 2. Was Smith allowing strangers to enter his home for a mere $10 cover? Hard to imagine, but quite possible given the circumstances. 3. Is he not aware that it is illegal to sell alcohol at residences? It's also illegal to sell without a liquor license in California. Look for California ABC to launch its own investigation. 4. Is he short on cash? Seems as though Smith was looking to profit by promoting a nite club-like business (with cash transactions) at his home. 5. Where are the strippers in this story? 6. Is Aldon Smith r****ded? Has the commissar goodell suspended anyone in season? If not, this would be the appropriated time. The league cannot stand for this! 3 games is perfect. =) But if the commissar doesn't step in, I fear Harbaugh will be extra tough on aldon and suspend his Xbox for half a day or something.

Actually, no it isn't. Pro athletes do stupid #### all the time. We even have one ex NFL player awaiting trial for murder. Common sense is not a requirement to be a NFL, NBA, MLB, or NHL player.
