[accident] dealing w/ other parties insurance

    I was in an accident over 2 weeks ago off Richmond and Drexel. Police came out, established it was her fault and gave her a ticket. Got her insurance information, etc (didn't get her cell, which I guess I should have).

    2 weeks later, she has (very conveniently) not been able to be reached by her insurance. Her insurance is saying they need a statement from her before they will pay anything. Is this bull**** or is it how it works?

    The police report should be fairly conclusive that it was her fault, and her insurance (Safe Co) has gotten that information as of 4-5 days ago. I have State Farm.

    What are my options at this point? I'm due to speak with her agent in a few hours.

    The insurance will have to pay up regardless if they get in contact with her. That's their problem not yours. Where are the boards attorneys?

    my advice to you, mainly listen to codell if he sees this and posts, he deals with stuff like this for a living.

    You pay your insurance agent for a reason. They should be working this with her insurance company.

    your insurance deals with their insurance, you don't have to do anything except bug your agent

    I had the same thing happen around 4 years ago. State Farm was having major issues with the guy who hit me and his horrible insurance. They told me the day after the wreck to find a good auto body shop and take it in for repairs, and that they would take care of dealing with the other insurance company. My car was fixed in 4 days but it took them over a year to get the money and to even collect back my deductible. I loathe cheap insurance carriers.

    Had this happen to me like 8 years ago. Other person hit me, they had some cheap insurance that couldn't contact the person that hit me, and didn't want to pay up. After a week of them saying the same thing over and over, I called them and said I'm going to file a complaint with tdi and magically they paid up that same day.

    DO NOT TALK TO HER INSURANCE COMPANY. LET YOUR INSURANCE COMPANY DO THAT. I CANNOT STRESS THIS ENOUGH.

    contrary to what everyone else is telling you, do not talk to the insurance agent yourself. Let your insurance company talk to them

    Where the hell is everyone getting their advice from?

    Anyhow, since you got the police report on your side, you should be okay. Safeco isn't lying to you when they tell you that they need a statement from their insured; that's standard operating procedure. There's a time limit for that, and if their customer never gives a statement, they will close the case without it and make their decision. Then, if it's as clear-cut as you say, then you'll be paid. IF time is of the essence and you want your car fixed right away, go ahead and claim with your company and let them get the money back from Safeco. From my experience, SafeCo is not trying to screw you, but you're more then welcome to inform your own insurance company of a fault free accident on your record to avoid the perceived hassle/potential hassle...it shouldn't jack your rates anyways.

    You mean the advice where most of us are suggesting that his insurance agent deal with the other firm? What's wrong with that?

    At least you got your report in a timely matter. The **** hole that is Henderson, TX.......took their cops 2 over 2weeks to get me the completed police report.
