The situation when giving birth is quite different, as the body actually changes and prepares itself beforehand. AND if she was hurting and told Kobe to stop and he didn´t IT`S RAPE.
Let's run an OJ scenario, he's deemed innocent of the sexual assualt charges...would the victim (and I'm starting to believe that she was...although who the hell am I and what do I know?) have a civil case that could be fiiled? Think about your daughters/nieces, etc. If he's guilty he should receive NO SPECIAL treatment, I don't care how many "7 up yours" commercials the guys can run off...oh wait, Sprite is his sponsor. Let me ask again, could the victim file a civil suit against Kobe if he is found innocent of the charges?
Of course she can, and she'd be more likely to win than the prosecution. The burden of proof is not as high. I'd like to point out that jamma34's article about the bellhop is from the nypost. I'm no Bryant apologist, but it is only fair for me to discredit their reporting here when I consistently discredit its reports of trades, signings and, well, everything basketball-related. It may be true, but I'd like to see a reputable paper report the same thing.

Pietrack reportedly told police that the woman was visibly upset, disheveled and had red marks on her neck and face, according to Smith. Sources close to the investigation say Pietrack is considered the first link in the chain of what is called "immediate outcry," meaning he is the first person the alleged victim cried out to immediately following the alleged incident. The alleged victim went to police the following day, approximately 13 hours after the alleged assault. Sources also said that photos taken of her at that point show the marks. Those photos are considered part of the prosecution's evidence. Pietrack has not spoken to reporters and has declined repeated requests by ESPN. Bryant is scheduled to attend a preliminary hearing on Wednesday at the Eagle County Justice Center at approximately 6 p.m. ET. Bryant will be read the charges against him and may enter a plea.
Thanks. Ain't it sad when ESPN is given more respect in reporting a court case than a newspaper? It has more details on some things and less on others. ESPN doesn't mention she told the bellhop she was raped. But even so, the Post may be spot on or, at worst, embellished a little.
we still have to wait to see how this all plays out...but kobe already took his shot at this girl's character...now the evidence is mounting up against him. this isn't looking so hot for him right about now.

So maybe she told Kobe, "let's get freaky, I like it that way." She may have been raped, but I think its equally likely that Kobe could be a mark. Again, I would tend to question the credibility of someone who tried to take their own life (if that story is true) only a couple months prior to the incident. To me, killing myself sounds like a more extreme action than pulling a con. But if the defense can't get the suicide attempt into evidence, Kobe may be in trouble.
this just popped into my head today and maybe im missing something really obvious here but bear with me: this is basically a he said she said thing, so why not strap them both onto a polygraph and see who is lying??
polygraph tests are so unreliable they're inadmissible at trial...that, and they ultimately would do the jury's job for them. which means no trial by jury. which means unconstitutional.
wait...if true that she came out crying, visibly upset with torn clothes and marks all over her face and neck...you think it's equally likely that it was just consensual sex? i'd be striking you from the jury pretty quickly!
Actually, I'm just keeping an open mind - I think it is equally likely a sexual assault occurred. Nevertheless, how long was it from when she left the room until the bellman saw her? Time enough to stop by the restroom and tear her own clothes? Scratch herself? Or did the bellman see her walking out the door to Kobe's room? We don't know at this point. We see movies with much more elaborate frame-up plots, and are entertained by them. I do believe that Mike Tyson raped Desiree Washington, but it is common knowledge that she received several million dollars in a civil settlement. With that kind of money being thrown around by celebrities in these types of cases, its easily to believe a famous athlete would be a target for a criminal complaint followed by a civil lawsuit.
yes...but at this point there is no civil lawsuit. not saying there won't be...but this didn't start with here seeing a private civil lawyer..this started with her family calling the authorities. i think it is more likely than not...assuming all this evidence is true...that she was raped. yes..she could have gone and put on a sad face...could be a great actress...could rip up her own clothes and inflict her own wounds...but i find that pretty dubious.
Just seems strange that it would take so long to press charges if what we're hearing in the media is true. So...she apparently had marks and bruises all over her body and immediately after leaving the room she said she was assaulted....yet it took how long to bring charges?
DCkid -- there are a ton of reasons why that could be...not the least of which is the mental health of the victim and her willingness to participate in proceedings...particularly those that would be so public.
