[Serious] How to Break Contract with Real Estate Agent?

    My friend ... just tell them NICELY that you want to break, but very clear that nothing they can do to earn that commission.

    They will break. They are not in the business to hold people up.

    Typically, it's 90 day exclusive listing ... if it is already a few month into the process, I would make sure if already out.

    This is not true. If the offer is equal or more than than you stated, you may refuse the offer, but you will have to pay the commission or fees to the broker. I would go over your contract or hire an attorney.

    Do not get a lawyer involved for this ... what is the point to switch if there is an offer, just do it with the current agent, remind the agent that he needs to exercise whatever effort and diligence is required upon him/her, and if the deal falls apart b/c the agent's oversight, then get a lawyer.

    Ask for a "Termination of Listing," TAR 1410.

    Let them know why you are looking to terminate the listing (have good reason).

    You may have to:
    1) Pay a fee
    2) Still pay a commission if the house sells - this is IF they check the box that goes with this which has 2 options a) Anyone b) people they list out - potential buyers who they procured during the listing agreement

    Or...

    They will let you go with no problem.
