Hospital Granted Request 'No Black Nurses' Lawsuit

    Sorry, my understanding is once they are on your floor, you have all the responsibility and have full control. The father can ONLY refuse, - I'm sure with a waiver. I'm not sure why shifting assignment (of the nurse) will "ensure the patient receives the best possible care"?

    The father should not interfere with medical decisions/procedures. They can ONLY refuse. It is possible that the baby's case was delicate enough that the hospital decided to assign the best nurse to care for the baby. She happens to be black. The father's silly request is an interference to providing the best care for the baby.

    I don't know why you would agree to that request.

    Let me say again, since you seem to be skipping over it, I am not discussing the morality of leaving a baby to die. I know very well that once a patient is ADMITTED they are the hospitals responsibility. I know very well that in the ER OR INTENSIVE CARE UNIT you must treat them. That is NOT what you were saying earlier, i.e. that a hospital has to treat anybody who shows up. That is the only point I'm discussing with you, and the fact that you can most certainly choose to not admit a person or kick a patient out (violence, bigotry, not following direction) even after they are admitted if they are not in an emergency situation. To say that this isn't true is a blatant lie, I've seen it happen.

    NVM Lynus, after re-reading we are coming at this from two completely different perspectives. I agree with the moral and ethical principles you are presenting, I would treat the kid in spite of his parents as well even if it wasn't an emergency.

    The nurse acted correctly. She confronted the issue AFTER the care of the baby was done and over with. I'll probably do the same. But I will understand those who will choose the easy way out.

    I do not believe the nurse should receive financial compensation. For two reasons, one is that it causes frivolous filings in regards to a situation where there appears to be no current and/or future financial harm to the plaintiff, and second, the assumption that the plaintiff is only interested in money over shadows the real issue.

    The hospital will and should be liable and fined to prevent similar future behavior.

    I hate **** like "if reasonable", but yes, the hospital should if they can. Fact is I can play your crap right back at you. There is a line where the patient has the right to make requests from the hospital, after all. Dictating which requests are or not permissible is a matter of judgment, so don't go on some ridiculous diatribe of doctors should ignore the wishes of their patients, which is a bad idea for incredibly obvious reasons.

    "It is possible" is not proof. If the black nurse was the only one who could do this job, then perhaps the hospital should have sent her down. I seriously doubt that the black nurse was, in fact, the only one who could do her job.

    Sure, the patient can make a request. The hospital can also deny the request, and should deny it. The fact is that the request has nothing to do with the health of the child. The child's health would not be in jeopardy based on the nurse's race.

    A hospital . . . should not be an instrument for the enforcement of prejudice.

    And why should they deny it? The baby got the care it needed from a black nurse or a non-black nurse. The only harm caused in this case was someone's feelings got hurt. That would've happened in either situation.

    Say the hospital denies the racist father's request. The black nurse cares for the baby. She and the hospital staff are then subject to a racist tirade by the father. Feelings get hurt.
    Now the hospital obliges the father. A white nurse cares for the baby. Racist father leaves with his baby. Black nurse feels slightly offended.

    Which situation is worse? Having a neo-Nazi father create a scene, or having a black nurse quietly be slightly offended.

    The hospital is in a lose-lose situation. And now they're being punished more while the real offender, racist neo-Nazi father, will continue to be racist.

    They should deny it, because you don't allow patients to make racist decisions for the hospital. The problem is that in health care situations the hospital makes decisions. The patient can deny care if he wants. If he does that, then the hospital can call child protective services.

    The situation that is worse is moving a black nurse away from her assigned duties because of her race. Accommodating racists is the worst thing.

    We don't know that the father would have made a racist tirade and created a scene. If he did, then the responsibility is on the nurse to deal with it professionally.

    No, I have noticed that you would side with whoever is on the "black" side of an issue - no matter what.

    To me, that is being racist.

    Please link me to one example on this BBS where you would have taken the side of the person involved in any kind of argument or conflict that is not black, if there is a black person involved.

    Heck, you even wanted OJ to be acquitted, when it was totally obvious that he did it.

    I didn't know "offend" and "be racist towards" meant the same thing...who knew?
