Sorry 40 now.

8 tiny squares + 18 small squares + 9 large squares (4 small squares) + 4 larger squares (9 small squares) + 1 huge square.

 

I get 40

 

I'm stuck on 39... I know there are more but can't find

nm: I found the same as pirc1 but miscounted... so I'm at 40 too

I'm up to 4, but I can't see any more.

Trick question. There are none. It's an optical illusion and the "squares" are really circles.

The reason some say 41 is that they are counting the picture you posted as a square as well (the white part).
