    Glad you don't sound like one of those chumps who sue people when you, physically are ok Lil Pun.

    People don't mean harm in wrecks most of the time and they are called. Accidents for a reason. Human decency and forgiveness is hard to find these days.

    Yeah, I remember when the previous accident happened that I mentioned on the first page I received hundreds of letters from lawyers basically asking me to sue the insurance people for more and not to handle it alone. As long as the stuff I mentioned is taken care of I'll be fine. I don't need to seek $50,000 on a get rich quick scheme.

    Damn, the second day sucks though. My arm is burning, my chest and abdomen are hurting and my neck is sore and stiff but yesterday it was fine.

    You should get treated for all those things about which you're complaining, and save the receipts and all costs, and let the other insurance know. Give the soreness and stiffness a couple days (today, tomorrow, etc.) to adjust, but if it's truly something you need to get checked out, don't wait too long.

    Let me get this straight. You got sandwiched? So, did the Lexus rear-end you, or did you rear-end the Lexus? Either way, you probably could've avoided the accident by leaving more space between you and the car in front of you.

    So, you were there and saw the entire accident? How can you even begin to talk about avoidance when you have no idea of the complete circumstance? Based on Pun's comments, the police (you know, the folks that actually investigate based on facts) disagree with you.

    pretty much the best advice. Stay out of it. More negative than positive can come out of you contacting her and in a situation like this you don't need emotions coming into the mix.

    Often times a person will be hysterical/apologetic at the scene and once they get home and talk to friends, family and lawyers all of a sudden she's the victim and you're at fault.

    I was rear-ended by the Lexus, tell me how exactly I could have avoided that and why don't insurances require whatever this is so that nobody ever gets rear ended by somebody else?

    I was in a wreck almost 2 years ago. Only advice I can give from that experience is don't settle too early on the bodily injury claim side. I went to a chiropractor to fix the whiplash issues i had in my neck & back for 14 visits but stopped going after that because I felt OK. They billed the insurance company a lot of money milking them and I felt pretty guilty about that because I didn't think I was hurt as bad as the chiropractor bills turned out to be. When Geico came to settle up with me, I only asked for a minimal amount of money for the inconvenience of it all and to replace some lost wages. About 7 months later and to this day, I have recurring issues in my back where I had the original whiplash. I should have asked for atleast $1,000 extra for future medical costs [massages/chiropractor] because looking back, I really needed it. My body has not been the same since.

    But, you should have been at least 100 feet behind the car in front of you. Then you wouldn't have hit it. :)

    Damn that sounds like a really nasty accident! Glad you are mostly ok and recovering

    Joshfast's advice is the one I would follow: just let the insurance people take care of it and don't get any more involved personally. Maybe you can contact her after the whole thing is settled, but I don't recommend it.

    Yeah, I probably won't contact her at all, like DonkeyMagic said above I don't need to provide any ammunition where this could be flipped on me.

    My mother contacted my insurance company this morning they told me not to do anything at all since the police report identified the other driver at fault her insurance should be handling the situation. They did say save any medical documentation, bills, receipts, etc. that were caused by the accident. They also said to keep my insurance active until it is all settled in case the other insurance provides me a rental car. They said the only reason I would need to contact them is if the other insurance is dragging their feet getting it settled.

    FWIW, I have State Farm and she has Farm Bureau.

    I'm guessing what I was told is what I should be doing.

    Def contact Farm Bureau early and often. No need to wait in that regard. No one will advocate for you other than yourself.

    Call them up, tell them who you are, give them the name of the person & their policy # and ask for the claim # and who the adjuster is assigned to the accident for your files. Good start.

    If he was stopped at a light, then its easy to hit the car in front of you when your hit from behind

    Lil Pun, why don't you want to get a lawyer? The mental anguish anxiety of someone crashing into you again is always gonna be in the back of your mind. You could of been paralyzed. Find you a good lawyer and let them handle it. This is your life.

    Yeah i got in a wreck 3 or 4 years ago where a guy didn't signal and pulled into my lane and almost hit me. He would've if I didn't move over. Natural split-second reaction was to turn away from him and I ended up hitting a tahoe and we both spun out of control on 35W in Fort Worth. When I stopped spinning, I was facing oncoming traffic and a big white van was coming right at me head on. He slammed on his breaks and hit me but luckily not as bad as it could've been. Scared the hell out of me. I still yell at every person who doesn't use a turn signal. Such a simple thing to use that can prevent so many wrecks. In the end, the car that pulled into my lane drove off and left me hanging. The cop said next time that happens, let it hit me. Even if the guy who pulled into my lane was there and the cop could talk to him, as long as he didn't actually hit me, it was all my fault. I get it but it sucks. When the lady in the Tahoe got out and ran to the back door of her car and pulled out a baby, I couldn't talk. I choked up a little. It could've gone so bad but thankfully traffic was light that morning.

    I'm just thinking it'll be less stress on you and your family. If you know a lawyer you know and trust to handle everything. You need to look out for yourself and your family.The insurance companies gonna give you what they think is fair but it might not be right.
