Whether or not it should, that has been the case this year. If they don't have the ball, it is a foul on the floor*, because they are not in a shooting motion. And the refs are calling it that way. *except for superstars

As much as I dislike the refs, that would be incredibly hard to decipher when the play is in real time. We have the advantage of replays so of course we're judging when it's slowed down.
