LOL - come on Bobrek, there is no reason for employers to have all that personal information, it is none of their business. I run a business, and I could not give two craps if someone was arrested etc, I do care if they can do the job I ask of them, and if they can't they are fired. Now we do run background checks for major felonies though......but not for POCS, or some such deal. And yes, if it takes lying to get a job, then that is fine by me. Because just wait for the layoffs to come up and the boss lies to them about there not being layoffs....you don't owe companies anything. DD
Really? If I were an employer, I'd definitely want to know if a potential employee ever took deferred adjudication and what they were accused of. If someone stole something, I'd want to know. I also want to know how much I can trust a potential employee. Do you think a banker cares if a potential employee stole before? Do you think a day care employer cares if a potential employee sold drugs before? Just because YOU don't care or think it is any of your business doesn't mean others don't care.
That's tough pgab, I spent like 15 minutes in the pokey in the middle of Missouri last year. I'd been pulled over in 2006 by a cop who was friends of a friend of mine, my friend contacted the cop and the cop said he pulled the ticket, but obviously he never did. Luckily the cop who "arrested" me took me to an atm to pull out the fine money so that I would have to hire a bondsman. I was never cuffed and rode in the front seat of the police car. The 15 minutes I was in the cell was when the one of the two deputy's working had to leave for something and I couldn't be alone with the one remaining deputy. It was the worst 15 minutes of my life. I suspect your ticket is still outstanding -- and depending on the paperwork, you may have a fleeing custody charge there too!
That sounds like a very unethical way to do business and one that could come back to bite you on the ass very hard. A few years ago wasn't there a bunch of people busted for lying on their resumes? You might not think lying that you weren't arrested or had deferred adjudication is a big deal but I bet there are a lot of employers who do. What is worst though is if an employer finds out later on that you had lied which could get you in more trouble than if you just told the truth in the first place.

It certainly does not go as a charges dropped situation. In fact, a successfully complete deferred adjudication is still considered a conviction for federal purposes. I know judges tend to say your case is dismissed once you complete a deferred, but that's not technically correct. True, for state purposes you don't have a conviction, but it's not the same as a dismissal. If it was you could get it expunged - which you can't. What you can do is file a petition for non-disclosure. It is discretionary from the judge, but when when dealing with a misdemeanor or minor felony (assuming your record was clear beforehand and is still clear when you file the petition) it will most likely be granted (after waiting the appropriate amount of time following the completion of the deferred). The non-disclosure prevents that is not in law enforcement from seeing it (which is how it differs from an expunction where even law enforcement can't see it).

That's not certain. As politics should teach us, the coverup is almost always worse than the initial scandal. In a case like this as an employer if you thought the employee could benefit your business you should give them the chance to explain why they were in the legal situation they were in. Being honest with an employer shows that you are trustworthy in an tough job environment trust is an asset. That works if that is the specific question. If the question is "Have you ever been arrested?" is a different matter.
I know right? Places like Massachusetts and New York are awesome! No police and no traffic laws because they have an income tax! Up there you can drive 100 down the freeway with cocaine on your mustache and weed stashed in the bra of the hooker you murdered in the back seat and no one will ever know because there are no cops to pull you over for breaking speed limits that don't exist! We were on the way to a concert at Numbers and stopped to piss behind the Stop and Go on Montrose and Westheimer. Yeah....not a good idea. The cops thought we were doing something completely different and took us to jail anyway. Spent the night downtown in a holding cell with about 100 other guys. Luckily, my girlfriend bailed me out the next morning. $250 for 'indecent exposure'. Most expensive piss I've ever taken.

no problem I just wanted to talk about the jail experience. there is a lot more to this story as said earlier. let me say this, we do some legit work i just don't want to get into what we do. there is enough personal info in this thread already.
Is the law such that since it was your car, you were just as responsible as your friend? Could your friend have gone to court, admitted it was his and had your charges dropped?
