Supreme Court: Cops can break-in to your house if they smell weed

    I know a few cops who smoke weed, not even lying. I need to ask them what they think about this.

    I don't know anything about that video. What I saw was in Slick Willie's on Monroe like in 2004. Grew up in Southeast side so It wasn't the first time I'd heard gun fire but it was the first time I saw a guy die right in front of me. Scary stuff.

    Yes, thank you, I'm aware it was 8-1 and that W didn't appoint all 9 of them. Don't know I agree with your math, but understood.

    Perhaps I should have clarified that it was because he appointed Alito that we get this that I will repost.:

    Justice Alito writes:

    When law enforcement officers who are not armed with a warrant knock on a door, they do no more than any private citizen might do. And whether the person who knocks on the door and requests the opportunity to speak is a police officer or a private citizen, the occupant has no obligation to open the door or to speak. Cf. Florida v. Royer, 460 U. S. 491, 497-498 (1983). (“[H]e may decline to listen to the questions at all and may go on his way”). When the police knock on a door but the occupants choose not to respond or to speak, “the investigation will have reached a conspicuously low point,” and the occupants “will have the kind of warning that even the most elaborate security system cannot provide.”

    It's a far cry from the mentality of the 1948 case and interpretation that justtxyank posted.

    I admit that my displeasure with Alito, and W, doesn't start or stop there, and probably because of that I should have refrained. After all, somehow this has stayed in the hangout.

    The burden of proof that the entry is illegal will be too high.
    Juries beleive cops over citizens.

    The court said no even if they enter illegally you are not allowed to assault them.
    I find that disturbing . .

    Question: At what point, can someone DEFEND themselves against the police?

    It's almost a good thing. What a nut. Hopefully cases like this will make news and people will start to realize what they've been complacently approving of in this country.

    This is the same case I posted on the first page and others summarily dismissed as "oh the facts are different". My intent was to show the trend toward eradication of the 4th amendment, little by little, by expanding definitions and scopes on a state and now federal level.


    Reasonable is determined by the masses in power.

    The masses have very little to do with the decision - things like this are usually determined by a small percentage of powerful/wealthy people.

    Most people believe that if the "masses" don't like something, that something will happen ... but seriously, what are we realistically going to do? We're reaching the point where the only option we truly have is massive revolt.

    So basically cops can bust your door down anytime they want citing the smell of weed and/or the sound of you destroying evidence. Guess that eliminates talking/moving/and using the toilet.

    this isn't about smokers vs non-smokers


    true, smokers will probably care more. but why should anyone else care less?

    1) Non-smokers shouldn't care AT ALL about what other people ingest. It's their body, their lives, not your issue.

    2) This violates the very principles that America was founded upon.

    3) LET PEOPLE DO WHATEVER THE FCK THEY WANT AS LONG AS IT DOESNT HARM ANYONE

    and then when it DOES harm someone, thats where law steps in. Law shouldn't be encroaching in our private lives

    on this same note, meth heads should prosecuted. its harmful.


    but not in the comfort of their meth'd out homes. there has to be DUE LEGAL PROCESS
