Sheila Jackson Lee: Arguing that the Commerce Clause provides the constitutional basis for ObamaCare, Jackson Lee said repealing the law by passing Republicans’ H.R. 2 violates both the Fifth Amendment’s right to due process and the Fourteenth Amendment’s equal protection clause. “The Fifth Amendment speaks specifically to denying someone their life and liberty without due process,” she said in a speech on the House floor moments ago. “That is what H.R. 2 does and I rise in opposition to it. And I rise in opposition because it is important that we preserve lives and we recognize that 40 million-plus are uninsured. She continued, “Can you tell me what’s more unconstitutional than taking away from the people of America their Fifth Amendment rights, their Fourteenth Amendment rights, and the right to equal protection under the law?”
Sounds like an interesting new argument to me, certainly not as far afield as many of the tea party's lunatic theories, thanks for posting.
And this is the furthest extent of basso's ability to comment on his own thread. But at least it's an accurate statement, for a change. Thank you basso, again for posting. you may now head off to Free Republic in order to attempt to educate and salvage.
Bachelor's from Yale, JD from UVA. I can't tell if that makes her argument less credible than your copy/paste sarcasserole or infinitely more. Tangent. Her husband, Elwyn Lee, is a long-time VP/Vice Chancellor at U of H. One time some student group had a bunch of black comedians come to campus (including the "Hamburger" guy). Dr. Lee's a pretty big guy, so at the beginnin of the night the emcee called him the "Nutty Vice President." Well, right after one of the comedians finished their act and the emcee came out, Dr. Lee gets up and sneaks to the back of auditorium. The emcee notices it and ribs him about it, even doing an impression of him running up the aisle panting and heaving.
The CONGRESSWOMANNNNNNNN strikes again! I'm surprised she didn't drop the two Vietnams reference at the end of her speech, that is my all time favorite Queen Sheila moment! As a Houstonian I thank God everyday for having Queen Sheila around, whenever I'm having a bad day I can always depend on her to make me smile!
What does this have to do with Lee and her due process argument, hatched in <s>New Haven</s>...Charlottesville? You should apply to the US PTO for IP protection on the "attempt to derail your own thread after a fail" process.
This is outrageous. If the Republicans had advocated universal health care for only the people they deemed "real Americans" then maybe the comparison would be more appropriate. Republicans would never do a callous thing like that. They just believe healthcare is only for people who can afford it.
i'm no constitutional scholar, but i'm pretty sure "the pursuit of happiness" should not require one to purchase health care from the government. <object width="518" height="419"><param name="movie" value="http://www.eyeblast.tv/public/eyeblast.swf?v=hd6UaGytyt" /><param name="allowFullScreen" value="true" /><embed type="application/x-shockwave-flash" src="http://www.eyeblast.tv/public/eyeblast.swf?v=hd6UaGytyt" allowfullscreen="true" width="518" height="419" /></object> and btw, what the hell is a "jörje?"
