So I cancelled my Gym membership back in October. I sent the form to their offices and assumed that was that. Today I check my balance and I see charges for 32.16 for Nov, Dec, and Jan. I am speaking with the manager tomorrow. Ive heard stories of how la fitness does not give refunds no matter what. i was thinking if that is the case I can report my card as lost and claim those charges as unauthorized to get those back on my account. problem is they have records of charging that card in the past. or since the charges are still pending can I report the card as lost and the charges will never process??
Fraud is not a good idea. Call your credit card company and tell them that you cancelled your membership and request a charge back. Ofcouse the gym can say that you still owe them the money and send you to collections if you refuse to pay.
Were you under a contract? Never EVER cancel anything by mail and assume it's done. Consider it a life lesson and move on. You can't prove they received it unless you got delivery confirmation. Your only shot is calling where you mailed it and hoping they did receive it and failed to file it.
Bally did the same thing to me many years ago. I think my balance is ~$1k. Not paying those jerks a dime.
i had a credit card that i choose not to renew... i figured that the reoccurring subscriptions tied to that account would expire along since there is no valid account to charge... little did i know, merchant can keep charging you up to a year... FML
If it's Gold's, i believe they require 90 day notice of cancellation. Basically their way of screwing you out of an extra 3 months of payments. When I "transferred" my membership from Golds in Austin to Gold's in California, they tried to charge me the extra 3 months. I told them I transferred the membership. They said they weren't owned by the same people. Yadayada. So, I was being charged by Both gyms for 3 months. I eventually got my money back, but it was a total pain in the ass and required many phone calls over a long period of time to make it happen.
Don't even bother. Im going through something similar and the bank won't help me. Unless you have some kind of confirmation, they won't do anything. You can call them and tell them you did not authorize the charges but they will not refund you. And then ask them to reissue you a new card as they will not end the membership.
A lesson learned: Always send certified mail when dealing with cancellations. The burden of proof is always on the consumer.
Well I called paypal and they are giving me my money back. Lady on the phone was nice. Told me they are now on their watch list. If they charge me again and they will dispute the charges. I gave them a fake bank account number so good luck trying to charge me.
