I ordered this shirt from a small online store. I get the shirt in the mail, and it's not the size I ordered. I email the store. I say I ordered a L but you sent me an XL. The guy says "Oh, I remember that. I authorized that one. We were out of L's so I went ahead and sent you an XL instead. If you don't want it, send it back to us and let us know you want a refund." Okay, so I'm a little annoyed by that. It's a big hassle to return stuff like that. I waver between keeping it and sending it back for a couple of days, then I finally send it back. Before anyone asks, I didn't get it insured. So I wait a few weeks, and email the guy to see if he's gotten the shirt yet. Hasn't seen it. I remember that my wife had just sent something to my sister-in-law and it took 3 weeks to arrive, so I just keep waiting. I wait a few more weeks, and email him again...still hasn't seen it. What it's looking like is I order this shirt, the guy purposely sends me the wrong one, I send it back, it gets lost (supposedly...he could've received it for all I know and just not said so), so now I'm out the money for the shirt PLUS I don't even get it. Is this all my fault for not getting it insured? I mean I just don't have to do this very often, and I've never had anything lost in the mail, so I didn't ask about insurance. I figure this guy should at least pay me for half of the thing anyway. Any thoughts?
He doesn't have the right to "authorize" that. It wasn't what you ordered. Make him pay for the whole thing.
The store should've arranged and paid for the return shipping anyway after being told they messed up the order. Why should it be your responsibility to pay for the return, especially when they knowingly and purposely sent you the wrong item? If anything, they committed mail fraud by knowingly and purposely (rather than mistakenly) sending you something other than what you ordered (Well, probably not "fraud" really, but there's enough there to make a viable threat, in my opinion). I say it's not your fault, but I wouldn't hold my breath waiting for a refund. If it were me, I'd call the post office and get them to start looking for the package while also filing a complaint with the Post Office against the store. Sometimes an official letter from an official source can get people to treat you right. I know I've gotten better treatment once I got the State Attorney General or the Post Office involved.
Yep, you didn't order an XL, so proper procedure would have been to notify you that all L's are soldout. You should have insured it and had it tracked for your records. It's little price to pay for avoiding the situation you are in now. The guy won't pay cause he says he never received the shirt, but then again he should have never sent you an XL.
It works, though. I kept getting bills from MCI/Worldcom for cell phone service I never had. Each month, I would get the bill, then I'd call and wait and wait and wait on hold until I could get a customer "service" representative on the phone who would then immediately take off the charge and tell me I wouldn't be getting another bill. The next month would roll around, and the process would start all over again with yet another bill. It didn't stop until I filed a complaint with the Post Office. The Post Office sent a letter to the company, and I never got a phony bill again.
Freak, why didnt ya just wash it in hot to make it shrink a little. There isn't that much difference between a XL and a L. It would have saved ya alot of hassle.
sorta got screwed? you got bent over my friend... no way its legal for the company to send you something you didn't order... does your credit card's insurance cover it? tell your credit card people the story, then you shouldn't have to pay.
If you know a lawyer, you could get the lawyer to send a letter to the guy on his/her stationary. A threat of a lawsuit may make the guy give you a refund.
As drapg alluded to, it should be very easy for you to have this resolved by contacting your credit card issuer. If it is a reputable bank, all you need to do is tell them you dispute the charges. They will mail you a form to fill out and explain the reasons and then that's it. The charges will be removed andt hey will deal with the hassle from there.

If you order a baseball card, get it insured, and it gets damaged on the way. Do you get to keep the baseball card and get the full value of it?
hmmmm has happened to me many of times.... but I always seemed to order from a store that was "well known" never insured an item and never had a problem getting it to them.... sounds like this man is trying to stiff you... make him pay for it all .... tale him to Judge Judy.... hahahhahaha no but seriously contact BBB and report it! Thanks for the responses everyone. mrpaige: I think the idea (at least my impression) was that I'd send the stuff back, then get credited for the item as well as the return shipping. I'll check the post office (even though I don't have a receipt...great!), maybe they can look into it. 2K: The shirt was pre-shrunk. It was a pretty decent-sized XL. I thought about going down to Medium, but sent it back instead. Drew: I'd be very interested in that VH shirt except I have a personal rule that I won't wear a band shirt unless I saw them live. I never saw VH with Sammy...you got any other ones? My wife threw out all my concert shirts a few years ago without my knowledge. Also, why does it say "Emo/Punk" next to all your auctions?
