There are still probably fears of lawsuits. And employers should be able to be fire for any reason, it's no different than having the right to quit for any reason.

It sounds like your brother needs to document a set of work instructions for the position and then set up metrics to gauge the performance of people in that position. Or he can keep whining like a lazy b****. He does not sound like a very good manager.
Have you ever worked in a large corporation? When a head count gets created and somone get hired internally, they get transfered. Often managers will give people good reviews just so they can get hired by someone else in the company. Nobody is going to willingly take a mediocre performer off your hands. I had two of those people hired into my group a few years ago. They were from the same organization, and were dumb as bricks. We flew them all around the world to get trained and even after a year on the job, they couldn't do it. We put up with them because they were a buffer just in case of layoffs which happened a couple of times.
I don't think most of you realize how hard it is to fire someone from a senior position at a large company. I new someone that was trying to get fired/layed off from a very large company because of a non compete clause. He showed up for work only to turn on the light in his office. It took them six months before they could get rid of him and even then they didn't officially fire him. They just let him quit and tore up his non-compete. This was at a company with over 100K employees worldwide. Most managers just wait until layoff time and put the poor performers at the bottom of the list.
This sounds like application engineers working for Intel. A lot of the semi companies are filled with a bunch of hating Indians.
I work for the State in California so I know how hard it is to fire someone, especially a minority. But I can be done. It usually takes about 6 months and some bad evaluations. We've had a discrimination lawsuit that I know of but won because the managers are told to go through a document process before firing someone, including co-worker testmonies. It just sounds like his HR department is too lazy to go through the legal process.
Maybe your brother's story is true. I assure you its not the norm. These days, regardless of color, you could get fired for an attitude problem you had 5 years ago.
