I'm currently studying the Warren court (it's a survey class so my understanding isn't that detailed), where this historic case originated. Personally, I like the new limitations. Of course, my perspective comes from: Law & Order tv shows, The Wire, reality cop shows, friends who are cops, and friends who are criminals. It just seems that police are so handcuffed nowadays in terms of putting away criminals, that this can't be so bad. Smart criminals will still be able to get away with it and bad cops will probably get away with a little more than they did in the past. Good cops will have a slightly easier job and slightly-smarter-than-moronic criminals will be caught more often.

Hey, there were reality shows in it too. :) You can't deny that it has some influence in effecting your perspective...in addition to reading books and stats.

Can there be any doubt that the conservative Roberts Court is the most activist court in the last generation? I have never seen a court that has had so much disregard for precedent.

I don't understand how these are even significant, particularly the one that requires a suspect to verbally invoke their right to remain silent. Why does that cause a problem, or as the article states, make it easier to coerce a confession? If anything, it should make it easier and less ambiguous as to when an interrogation should end.

    simple solution:

Just don't talk to cops whether you are guilty or innocent.

Do you have the Right until you waive it
    or
Do you not have the right . .. until you invoke it?

except, if you don't talk to the cops, they can keep talking to you until you break.
