Had a friend arrested last night for DWI. Just wanted to know what the consequences of getting one was (your record, your license, etc). Any Houston lawyers can throw their pitch here..... dD
Do I know this guy? From my defensive driving recollection, I believe it's a class C misdameanor with a small fine. Don't know about any suspension of license or not.
You can get up to 6 months in jail, revocation of license for up to 2 years, one year probation, the breathalyzer thing in your car, or any combination of the above for this Class A Misdemeanor.
It helps if you're white, middle-class and can afford a good lawyer. Sad, unfair, but true. If you are a repeat offender, all bets are off. Needless to say, it's better to take a cab. Better for you, and a hell of a lot safer for everyone else. I have a friend who essentially ruined his life from having 3 DWI's in about a year. It's a miracle he didn't get someone killed. He was depressed because his wife left him with his best friend (not me!), taking their young daughter with them out of state. Sad story. He spent 3 months in jail and had his license taken away for a long time.
Is there an automatic suspension of your license if you get 1?? Can you get it removed from your record, or is that pretty much set in stone? I dont know the laws, but I know that you do need a lawyer. My friend also received a Public Intoxication arrest about 3 years ago...

It's very arbitrary. We know each other here. I got one. I got a 100 dollar fine and 2 years probation. I've heard of alot worse. ALso got 24 hours community service. It leaves a black eye on your record, and going to see your probation officer sucks. It' s obviously not good to get one, but it's not the end of the world.
That's horrible. After your second one, I've heard it's hard to even get a job. I basically catch cabs now if I want to drink. It's not worth it.
Sage advice...another thing I heard... You can drive and not drink. Or you could drink and stay on the couch. Be creative. Just don't operate heavy machinery after you've had a few.
In my younger days I probably missed a couple DWI's I deserved. Thank goodness I didn't kill anyone or myself. Chalk it up to luck and add it to lessons learned. *Side note* A few years back I was using a motorcycle as my daily transportation. On a motorcycle you really need your senses to be sharp or you can kill yourself real quick. Durring that time I adopted a "2 wheels, 2 drinks" policy. I never had more than 2 drinks if I was riding. Period. Since then I have addopted a similar policy when driving the car, "4 wheels, 4 drinks". It may on occasion put me over the legal limit, but I 've found I rarely get to the 4th drink if I'm driving.
Damn man, then we definitely need to watch out for these truckers on the highways. "18 wheels, 18..."
So if you get a Class B Misdemeanor, but only a charge, and not a conviction, can the FBI check through fingerprints and find that, even though it is only a charge? Like what if you were on deferred...could that even be found? I had a friend ask me that, but I had no clue.....anyone know?
