Why is the DOJ not charging Hasan with the Murder of an unborn?

    Wait - killing a fetus with intent (118) is the same level of crime as killing a fetus without intent (119a)? :confused: That's like saying manslaughter is the same level of crime as murder.

    I have not really followed this story thanks to the ugly politicization and nasty stereotyping (although, I pretty much think those stereotypes accurate).

    Anyhow:

    1) It seems to me like folks are inexplicably avoiding the "terrorist" label for a guy who is, clearly, a terrorist. The mass media and government seemed to enjoy this label for every joe blow who shook a fist at the government earlier - so why the not-so-subtle shift?

    2) Is he being charged for terrorism-related crimes?

    You can talk about it in different ways. I thought you were meaning to say, well they have him for felony murder but they are only going to try for assault. That's what I thought you meant by a lesser charge when you said, "It's unclear what level of offense that is. I mean, anytime there's murder, you can also charge people with other lesser crimes like assault, but prosecutions generally just focus on the biggest charges." I understand now what you mean, but in your example, assault is a lesser charge than murder, but it's not quite what you mean when you say lesser charge. It's just an easier burden of proof charge, hence a different charge might be more accurate. Regardless, there would be no reason not to go for 119a, although 118 would be harder to prove. To my knowledge neither has been done.
