Okay. Let me show you exactly how said officer built probable cause against you... 1) Most Obvious-2am and your driving around with no headlights. I dont care how many street lights there are, you figure out your lights were off. One of the first things you learn during your FTO days as an officer is "Nothing good goes on between 2-4am." 2) Once you were pulled over, officer approached your vehicle and noticed at 2am on a night where it is 50 degrees outside you were shirtless. 2 types of people are out underdressed in cold weather at 2am, drunks and people running to the store/emergency in a hurry. 3) You said he only did 2 tests on you, but if you were in Texas, you must have done 3 tests. Anybody who has to have a SFST administered to them must have 3 tests in order to be arrested, unless you give up on the tests before all three are finsihed. Now im not saying you were drunk or werent. Personally I dont arrest/ticket very much for 2 main things. Low case DWI in which you have alternate transpertation home and speeding. I really cant bring myself to be a stickler on these since I know that before I was a cop I did both on occation, and if certain officers wouldnt have shown mercy on me when I was pulled over, I wouldnt be able to be a police officer today. I guess its kind of like me paying it foward. Other than that, good job on not taking blowing. Im a certified administator and I can tell you that if your not 100% sure you have not drank at all, then dont risk it. As for you who said that cops hang outside of bars you must not be familiar with entraptment and how it pretains to officers, I dont know what city your in but if my supervisior caught us sitting outside of bars waiting on drunks he would have our asses. Not only is it morally and ethically wrong, our department would just be asking for a lawsuit.
***My fault on my previous post, I thought I read that you had no shirt on. Still being under-dressed for the weather typically they wont let that be an excuse, especially if you had an old school hard nosed officer to deal with.

I'm in Houston, and it is happening on Washington on a regular basis. It is interesting to have a birds-eye view of it from where I have seen it. And while they aren't parked outside the bar, they just cruise back and forth on the street. It probably helps that the main Houston police station is less than a mile away.

What the government does with its money from the offense doesn't change the fact that you were imbecilic (I used the word you just learned in a sentence. Rep points?) and irresponsible and got yourself drunk and then drove and put someone's life at risk. If your post had said "It's ridiculous that these cops bust these drunk drivers and then no money goes towards "changing the system" in some way to stop people from drinking and driving" maybe I'd agree with you. But really what your crying about (now) is that your butt hurt because you don't get to bar hop and drive like you could in the glory days where we didn't take killing someone with your car as serious as we do now. Well im not going to speak for Houston PD. There are alot of good ones, and they really are sharpening up their standards for new hire/advancement, but there is a reason I didnt want to work their, too much behind the scenes situations going on at HPD.
Also ,with the proximity to the station, thats going to be a hard thing to justify in court if your the citizen. I would just have to pick a bar that isnt so close to the HPD HUB if I were going to go out knowing I had to drive home lol
Really? I was given 2 tests at the time of the stop. Didn't give up on either one. Then when I was booked, I was given the chance to do the blood and breath tests, to which I obviously refused. Was I arrested after I declined those two tests?

I'm not sure this test is for anything BUT to tell you that you failed. I failed it miserably while being stone cold sober during a traffic stop. Since then, I have met two more people who whose eyes "twitched" just like mine did. One had not been drinking. The other, who I know quite well, had consumed 2 glasses of wine in 4 hours. I think these field tests are used, in many instances, to frighten or intimidate you. I know when I "failed" the eye test (after having aced the balance and motor skill test) the cop repeatedly told me if he gave me a breathalyzer I would "blow over." I was also pulled over illegally in my case. #$%^ these pigs and good luck with your case.
Great post. Count yourself excluded from my "$^%^& the pigs" statement in my previous post. I know police are not allowed to sit outside of bars but if you ever grab a beer at Fox and Hound in the Woodlands you will see them drive through the parking lot literally every 5 minutes as well as set up to catch "speeders" directly across the street in the Home Depot parking lot. Shenandoah/Oak Ridge police DO NOT LIKE bars and make every effort they can to intimidate patrons.
