"Contact must occur for an elbow foul to be assessed. It is an unsportsmanlike act whether or not there is contact. (See Rule 12A--Section VII-- d(6) for non-contact.) If the deliberate elbow contact is above shoulder level, the player will be ejected."* http://www.nba.com/analysis/rules_12.html?nav=ArticleList
*Unless Joey Crawford is the referee.
Unfortunately this Manny stuff happened today. Otherwise the media might latch onto the possibility of Kobe being suspended as a story. And the media could shed light on the NBA's missed calls and maybe make the NBA have to formulate a response. Even then Kobe will not be suspended, but it would be nice if this got more attention.
Kobe was indicted on rape, and all it took was an 81 point game for his Most-preferred-player status to return. He will not be suspended for elbowing.
