    Nurses Fired Over Cell Phone Photos Of Patient

    Case Referred To FBI For Possible HIPAA Violations

    LAKE GENEVA, Wis. -- Nurses accused of photographing a patient and posting the pictures on the Internet have been fired.

    The investigation started with an anonymous call from an employee at Mercy Walworth Medical Center in Lake Geneva, with the allegation that a nurse took pictures of a patient with her cell phone and posted them on her Facebook page.

    Last week, the nurse told 12 News she never posted the pictures on the Internet. Investigators have since interviewed the nurse and said she offered more details.

    "There were two nurses that independently took a picture each of an X-ray of a patient," Walworth County Undersheriff Kurt Picknell said.

    The patient was admitted to the emergency room with an object lodged in his rectum. Police said the nurse explained she and a co-worker snapped photos when they learned it was a sex device. Police said discussion about the incident was posted on her Facebook page, but they haven't found anyone who actually saw the pictures.

    The nurse removed her Facebook page from the Internet last week. Without more, Picknell said this conduct does not appear to violate any state laws. He has referred the case to the FBI.

    "We've notified federal authorities of this allegation to see if there are federal violations, most notably HIPAA violations, patient rights," he said.

    The hospital did not return a call seeking comment.

    I don't know if you have heard of a term called medical ethics or not. Working in medicine isn't the same as working at Denny's.

    I don't see how a picture of an Xray that does not say who the patient is so terrible. They aren't disclosing anything about the person.

    Is it right? Probably not.

    I guess it depends on the discussion. If the nurse just mentioned on her Facebook page "I had to deal with a patient that had a dolphin shaped vibrator up HIS ass today. Gross! (SMILEY)" then I see nothing wrong with that. No names were mentioned. They say pics were taken and posted but it seems no evidence of that other than the anonymous caller is available. So unless specifics to that patient (name, etc) were put on the Facebook page, does HIPAA really come into play?

    Unless this patient can be identified by the pictures of his/her Xrays (i.e. name and DOB on Xray is legible), not a HIPAA violation.

    Yes it does. I'm an x-ray tech. I've been at the hospital I'm at now for 3 years, and I live in a town of 30,000 and I've seen two or three of these cases.

    I've also heard stories of people with things lodged in their urethras and I guy that got his penis stuck in a crescent wrench.

    The last guy that got a sex toy stuck in his rectum at my hospital was 54...

    I also had a co-worker tell me one time that while she was taking a picture of a guy's abdomen the guy looked at her and seriously asked if she saw a gerbil in there....

    ....I love my job.


    And by the way, it is a HUGE HIPAA violation for someone to do this, much less the nurses...The nurses don't even have to access the patient's x-rays (at least, not usually) for them to do their jobs....that's big time HIPAA.

    It's a HIPAA violation for the nurses to go through the patient's x-rays because I'm guessing there's a 97% chance they did not need to look at the patient's x-rays to do their job. That's the doctor's job....

    It's an extreme ethics violation to post that patient's pictures on the internet without their consent.

    A kid almost got kicked out of the x-ray school I went to because he took a picture of a friend's x-ray and then sent them by cell phone to another friend...with the original person's consent. The x-ray tech that was with him got reprimanded also...

    Taking the picture was wrong. But I probably would have done the same thing in the same situation.

    HIPAA is a lot more complicated than that.
