Lingo problem - it is a dousy !

    So, I noticed last month I keep getting charged for this service on my Biz card called Lingo....it is like $50 a month, so I take a look into what it is...I have several monthly recurring accounts on the card but could pinpoint all but this one.

    Well it turns out that back in September 2005, one of my employees signed our company up for a Lingo account and used my corporate card to do it.

    Not that much of a bid deal, IF I could access the account etc....but here is the problem, the guy passed away about 2 years ago due to an anuriyism, so I try to call Lingo up and cancel my account.

    I get some guy in India, and he is like...sir, I can't do anything without your password to your account etc...I am like...huh? It is my credit card...and I can't get the password because the guy who signed up for it USING my card died.

    Sorry, I was told......so obviously I call my credit company and we cancel the card number and get me another one.......so after about 2 months, Lingo calls me today and goes..."Uh, your card is not working"...and I am like...NO KIDDING? Really?

    Fortunatly, the lady was nice and I explained my situation, she went back to July 2006 and could see no usage at all.......and she cancelled my account, and gave me another number to call....

    I called this number...spoke to a higher up, and they were like...."She should not have told you that info.....without the password etc.." and I am like....my CREDIT card...my NAME...hello !!!

    So she says she will call me back.

    My question is two fold.......

    1. How long can I go back and contest the charges?

    2. If the guy is dead, is there any danger that this could come back to his family in any way?

    I don't want to give them any grief, as I am sure he was doing something for the good of the company at the time....I just didn't know about it......

    The obvious first response is not to let other people use your credit card...but that's obvious and missing the point anyway.

    The idea that you have to have a secret password to stop paying for something, regardless of who, what, how, why or when is so stupid it makes my head hurt.

    As to your questions, Id' guess that on the first one, it is really up to the company. If the contract says you pay as you go until you cancel, and you never canceled, hard to argue contractually that you should be able to contest charges until you cancelled. As far as your colleague who passed away, I'd also say, assuming the guy used your business card with your permission, for your company, etc., I don't think his estate would have any liability.

    I was always under the assumption that you take your debt to the grave, unless it was something you co-signed on.

    I am confused. When he signed up he signed in his name using the company card? Or he signed in the company's name using the company card? Did you give him your permission?

    I left out the fact that the company went out of business 3 years ago....and I never signed anything.

    Well, having worked at a company previously with a very stern Credit Card purchase policy I think I may have answers for you:


    As far as what you can contest I believe you can only go back 6 mos. However if you wish to dispute the charges with your credit card company they will launch an investigation and may be able to garner a better arrangement with LINGO

    Considering the account was in the name of the deceased you could contest and cancel the account with something as simple as a registered obituary.

    No, I never gave him permission, but he did make some purchases for the company from time to time using my card.......I would not contest him getting it for the company.......

    The account is already cancelled, I managed to do that.......and the company is out of business so I have no personal debt.

    What I want to know is can I contest it, and how far back? Because at $50 a month, and for 3 years....that adds up to $1800.

    I doubt you would be able to make a case for contesting it. Have you contacted your card issuer and discussed the problem with them?

    yes, they said contest it.....I just don't want to get the guy who bought the account into trouble....he was a friend, and I think he was probably helping the company in some way.
