Good Samaritan Can Be Sued

    If the victim didn't want her friend to pull her out of the car, she should have SAID SO. If the impact was so strong, then both should have been unconscious. And how the heck did she become paralyzed from getting pulled out of a car? Really? It's just opening the door, unlock the seat belt, and pull. I think she was paralyzed from the crash.

    Anyways, not cool to sue. Her friend acted out of good faith. I bet her friend was PRAYING that she lives while rescuing her. Why ruin a friendship from something neither wanted to happen?

    It is very possible that the rescue attempt could've left her paralyzed if she was injured already in the crash by moving her improperly it could've made the injury worse while trained rescuers could've moved her in such a way as to limit the amount of damage so that she might still be able to walk.

    Pretty much you should just call 911 and that's it. At least that's my guideline in the future. If the rescue doesn't get here on time, that's not my problem.

    But was she conscious after the accident? I mean, why didn't she say she didn't want to be rescued? It really does make me think twice about helping people now.

    The woman who was pulled out of the car may not have been in a condition to talk, or she may not have known the type of damage that would have occurred from the other woman pulling her out the way she did.

    So many people taking the wrong lesson away from this. As far as I can tell, the care DIDN'T explode. I ran a search on this incident, and the allegation is that the woman who was paralyzed would have been better off if her friend didn't pull her out.

    One thing they made sure to teach me in health classes in school was that if someone is in a serious accident, you DON'T move them. You stay there, and call in professional help.

    The woman being sued likely made a stupid decision based on stupid movies, in contradiction to the way people are taught to handle accidents. It's very likely that she didn't save her friends life, that the car didn't explode, and that she's not some hero being sued by an ungrateful friend.

    The lesson is to be smarter, not to refrain from helping people if you can actually help.

    You may think you know what should be done, but how would you actually know for sure? We are not health professionals, so the lesson is call 911 and don't do anything.

    That's exactly what they teach you in school: don't touch someone who has been in a serious accident and may have suffered serious spinal injuries. Just call in the pros.

    But so many people in this thread, who have obviously not thought this through clearly, have dramatically proclaimed that this serves as warning not to help at all in other situations. Like stopping a rape, giving CPR, or getting a kid out of the way of a speeding car. This woman was a "hero" for pulling her friend out, and her friend is just being ungrateful and greedy. It's the end of morality and common decency, what is this country coming to?

    Except the car very likely didn't explode (nor should you think it would unless you've been brainwashed by stupid movies), the "Good Samaritan" was likely not a hero at all but a well-intentioned ignoramus who did more harm than good, and all those other situations are nothing like this one.

    I think that sums it up well and I withdraw my earlier statement as I thought I had read that the car was on fire. As someone who has been trained in first aid, and also someone who once got strapped to a board and some sandbags over the possibility of having a broken neck, you do need to be very careful about an injury.

    That said I don't like the situation of the rescuee suing the rescuer. Yes she is a a well-intentioned ignoramus but I would rather have well intentioned ignorami out there than everyone cold hearted. I think the best thing to take from this is that its important that everyone gets trained in first aid and learns how to evaulate an emergency situation.
