Immigration Question

    I was having a debate with my coworker and I need to know the answer. If you have a kid in this country can they still deport you? I figure they couldn't separate child and parent.

    You could apply for cancellation of removal but the short answer is yes, you can still be removed/deported even if you have a child here.

    The reasoning is the child could leave with you and still maintain their citizenship and ability to enter the country again when they are 18 or the child could choose to remain here.

    If you commit a crime and found guilty, what usually happens to the person children....?

    I'd say foster care or they would just go to live with another relative.


    On the illegal immigration issue, I'm assuming and predicting their parents would take their own kids with them, no matter what.

    The child can keep his citizenship unless they give it up when they go to the other country.

    Hispanic? has been a running gag of which you may not be aware since you just signed up. It's been stupid since it started and certainly has jumped the shark by now but folks seem to think it's funny.

    Yes, the child cannot petition for the parents to stay as Permanent Residents until he or she turns 21. The governement will deport you for a crime unless you file for relief from deportation (what kind of relief is availble depends largely on the facts/history of the parent).

    Usually, unless "exceptional and extremely unusual hardship" would occur, the parent who is deportable will be removed (in which case the kid would follow).
