Okay, so my gf came back and vented today about her job (some of hte things I've already heard). Anyways, she was hired as a full time sales associate for (ends in shack) and she's caught her store manager stealing things on numerous occasions and taking cash from the register. Well, she was told last time she was paid that she wasn't fully in the computers yet so he had to pay her with cash. Which he did from the register, and so she was paid her hourly amount with out including tax. It's against company policy to pay from the register, and I'm pretty sure illegal to pay her with out including taxes etc. She works roughly 30-40hrs a week. Well, today her and some of the other employess (with their help) looked up her information on the computer system because she should be getting paid from corporate now and not cash. Turns out the manager falsified her documents. When she was hired she signed everything etc. as a full time sales associate, he went back and whited out the spots she filled out and put her as part time 10hrs a week. He has been going back on the computers and changing her time stats from 30 hrs (last week) to 3hrs. And paying from the drawer. Today his daughter was in the store, and wanted an ipod. He went to the back, took the ipod out of a box and put the box back. My gf witnessed this, and about 2hrs later the manager walked out and asked all the assosciates if they knew anything about the empty box. She is planning on calling HR and scheduling a meeting with the regional manager etc. But she's worried on doing it before she is supposed to get paid next, thinking they might not pay her for her hrs worked. Also, the guy has apparently been using lewd comments at her (to her face), like saying how she's gifted (body) and sexy etc. (sexual harrasment). Anyways, just curious how should she go about doing something about this? Is there any reason to take this to court? She's upset, and doesn't know what to do....and I figured I'd call upon the knowledgeable base that is Clutchfans. I know it's long, thanks for the input.

She needs to document every single thing that she is witnessing. Presenting dates and times will provide more leverage on her case. Imagine someone is asking her when all these things occurred and her answer is an "I'm not sure, I think it was on...." Has she considered recording these events herself? There is nothing more damning than actual footage or a sound recording of these offenses taking place. What about the other employees? Would they be willing to acknowledge everything that she has witnessed?
Well it is a breach of contract between employer/employee. Unfortunately your girlfriend's recompense would come from the company not this guy, to whom is at fault for the payment mix-up. The sexual harassment is an issue she can bring up with hr...that will get him in trouble or even fired. If you are talking about wanting to collect, it would be classified as an intentional tort and you could probably press action on grounds of assault. She would need good evidence. Remember things like "surveillance" cameras might suffice in a personal tort. -V
This is a bad situation all around. If it were me in the situation, I would quit and ask for the final check. She needs to get out of it one way or another whether it's by quitting or going to HR. Eventually the missing stock is going to be discovered by someone further up, and the manager is going to blame it on her/the other employees. If getting out of it involves not getting paid for some of the hours she's put in, I'd say it's worth it to get out of the situation.
The sexual harassment stuff is small potatoes. Get him fired for the other stuff instead. Go to HR. You don't want your GF getting fired when he gets caught and says that she was in on it.
Remember if she is going to claim some type of employment discrimination under Title VII or payday charge she needs to file a charge with the Texas Workforce Commission..
