If that's the case, according to law the 17 year old can consent to sex, but cannot consent to a sexual advance in the 'workplace'. Yes, I'm aware of the differences between boss/employee and teacher/student...just my train of thought there. This is indeed a weird situation.
And every right to prosecute her, seeing as our congressmen, duly elected by the citizens of the State and expressing the will of the people, saw fit to make it a crime for an educator to have sex with a student.
Just like that plot with one of characters on Dawson Creek...he had a relationship with the teacher. Obviously, this problem has been around for years...we are just hearing more and more about this.
This does not require a stretch. The state has a huge interest in providing a school system where parents feel they can entrust their child to it without the child being a source of sex for the people running the system (ie teachers). They made it a crime to act as a deterrent to the teacher. I am sure that the teachers all know this law exists. It isn't like she didn't know the risks.

The indictments allege that Strickland-Terry had inappropriate sexual relationships with two male Willowridge students who were both under 17. The investigation started March 28 when police from the Fort Bend Independent School District contacted Brazoria County Sheriff's Office about the allegations. Sheriff's detectives said the incidents happened at the teacher's apartment. Strickland-Terry resigned from the school district shortly after the allegations surfaced, said Fort Bend ISD spokeswoman Mary Ann Simpson.

Teacher from Katy faces sex assault charge in Waco WACO — A former Brazos Middle School special education teacher has been arrested on a sexual assault of a child charge accusing her of having sex with a 14-year-old male student, officials said. Tara Allison Hodges, of Katy, was arrested Wednesday. In addition to sexual assault, Hodges was charged with improper relationship between educator and student, said Waco police Sgt. Melvin Roseborough. A jail spokeswoman said Hodges had left the McLennan County Jail on Thursday after posting a $150,000 bond, which was lowered from the original $300,000 bond. Hodges' arrest warrant affidavit alleges that she "had sexual contact with (the 14-year-old boy) on at least 10 separate occasions, and that during several of these encounters Tara Allison Hodges also smoked mar1juana with (the boy)." Authorities did not charge her with any drug-related offenses. Waco Independent School District spokesman Dale Caffey said Wednesday he does not know whether the youth was a special education student. He said WISD officials learned of the police investigation last week. "From the district's standpoint, when we learned of the investigation, we were shocked, extremely upset," Caffey said in Thursday's online edition of the Waco Tribune-Herald. Authorities allege Hodges and the boy had sex over a two-month period and that she twice gave the student money and bought him shoes. The jail spokeswoman did not have information about an attorney for Hodges. Caffey said Hodges had worked for three years as a special education inclusion teacher. Inclusion teachers work with special education students to incorporate them into mainstream classrooms.
