Court: Texas Had No Right to Take Children from Polygamist Sect

    SAN ANGELO, Texas (CNN) -- The state of Texas should not have removed the more than 460 children it took from a polygamist sect's ranch, an appeals court ruled Thursday.

    In its ruling, the Texas 3rd District Court of Appeals decided in favor of 38 women who had appealed the removals, as well as a decision last month by a district judge that the children will remain in state custody.

    "The existence of the FLDS belief system as described by the department's witnesses, by itself, does not put children of FLDS parents in physical danger," the three-judge panel said.

    The state's Department of Family and Protective Services "did not present any evidence of danger to the physical health or safety of any male children or any female children who had not reached puberty," the judges ruled.

    "The legislature has required that there be evidence to support a finding that there is a danger to the physical health or safety of the children in question and that the need for protection is urgent and warrants immediate removal," the ruling said.

    It concluded, "Evidence that children raised in this particular environment may someday have their physical health and safety threatened is not evidence that the danger is imminent enough to warrant invoking the extreme measure of immediate removal prior to full litigation of the issue."

    The children were removed last month from the Yearning for Zion (YFZ) Ranch in Eldorado, Texas, which is owned by the Fundamentalist Church of Jesus Christ of Latter-day Saints, a Mormon offshoot that practices polygamy.

    The sect is linked to jailed "prophet" Warren Steed Jeffs.

    Authorities raided the ranch after they received reports of child abuse.

    so what did they say about the report about all those pregnant or had been pregnant teenage girls?

    By the way, I heard yesterday on the radio that one of the "teenage mothers" that they had put in foster care was really twenty-seven.

    Technically, the state of Texas, through the Dept of Protective & Regulatory Services, took a very courageous step to protect these children by removing them from the compound. An action that several other states with FLDS cults will not even attempt.

    DFPS will be appealing this decision.

    I think the sect is producing(?) documents to make the girls that are pregnant or have had children be the age they need to be to make it all legal.

    Not saying they documents are fake but it's easy to forge documents in a closed society with noone to contradict them.

    Your fix is a matter of interpretation and perspective.

    As an avid supporter of civil liberties I agree with you in principle, and I understand how some may see this as over-reaching, but what is going on in these compounds is criminal.

    Don't be fooled; it is not a religious issue.

    As seen today, the courts may not uphold the action the state took, but it was the proper action.

    This will be in the courts for a while.

    people keep trying to make this a religion issue, its really a child safety issue. children don't have the same rights as adults, therefore they have extra protection from the system. sometimes this may step on the civil liberties of the adult, but the children come first

    1. The invaded the compound on the strength of a bogus phone call
    2. I still have not heard of EVIDENCE of abuse . . only ALLEDGED abuse
    3. They even held those folx for a while . . .

    I mean . . .i don't agree with this group or what they do
    but
    They seem to have shredded their life and lifestyle on the flimsey-est of evidence

    more like hints, allegations and inuendo

    but again, that is how cps works, and give that the victims they are trying to protect are kids, they have to go on flimsy evidence, inuendo or whatever. basing anything on the testimony of say a 12 year old is suspect to begin with. and from the otherside of the spectrum, because 12 year old never says anything doesn't mean said 12 year old isn't being abused.

    if everything is really a okay with this compound, then its unfortunate that it came to this. but the size of the compound has dictated the circus. its hard on the state to deal with but they can't ignore what they believe is out there because of the massive undertaking it would be to investigate. its just a mess all the around

    What proof? That is what bothers me. . .is so far

    well, there was a report about alot of pregnant teenage girls, don't know how accurate it was but it was reported in the chronicle.
