Getting out of a ticket

    Got a ticket last night coming home from dinner with the wife. Constable said I was going 57 in a 45 but I know I wasn't going anywhere near that fast. In addition, he was going the opposite direction when he said he got me with the radar. I said "I didn't think you had the capability to assess speed while traveling in the opposite direction." He said "you saw me turn around didn't you? Yes we have that capability."

    I can't take defensive driving again (too soon since the last one) and I don't want to do deferred adjudication since the risk of getting another ticket in the next 6 months is too high. Anybody know a good traffic attorney?

    You could ask the judge to dismiss the ticket and let you make a donation to a preferred charity. That actually worked for my uncle. He told the judge he would rather make a donation to a charity of the judges choice, or something like that, and the judge agreed and gave him 30 days to make the donation. Ticket was dismissed although he was still out a $100 but it didn't go on his record.

    Just google one. There are many in Houston. It will probably cost you about 200 bucks though.

    You also may have to pay 100 or so for the fine later (but no points will be added and it will be years from now)

    I think it's very possible to check speed going opposite directions. I seem to recall an experiment in physics in college on such a situation. Although college was a while ago for me.

    a) he can certainly assess your speed going in the opposite direction. And are you sure it was radar and not laser? Cause laser could definitely get you instantly, not even a half-argument there.

    b) the risk of a ticket is too high for deferred adjudication? Come on man...drive slower for just 6 months. Ain't that hard when you have to do it. At least when it's a relatively easy solution to your problem

    I usually just flash my man-boobs. If I was going really fast, I'll lick my fingers and touch my nips.

    You could always take the cop to court and hope he doesn't show up. I've heard they never show up and the judge usually drops the case, although I've never had the guts to try this method. Not sure if it's legit or not.

    I heard that too, and I too, am too scurrrrrd to try.

    You can minimize the risk by driving slower, 180 days is cake.

    It's worked, I've done it (not saying it will for everyone all the time though). Another method is to show up to court with a friend who is a lawyer, doesn't even have to be a traffic lawyer, just a lawyer who knows what they're doing in a courtroom. Many police officers who even bother to show up will see that you have a lawyer and tell the judge that they have a "conflict" and dismiss the case. In reality, they just don't want to deal with the case and your lawyer. <-- also a true story

    the cop will show up. they get out of doing actual work and they know the judge will just believe whatever they say.

    The best thing is to just delay the case then in a year or 2 settle for a small fine and no points on your record.

    It's a constable, he will show up to court. They have nothing else to do then to catch people speeding and go to court. I hate the constables (especially the one who gave me a ticket on the Beltway ... he saw the police coin I have when I was giving him my info which means I am related to someone who is an officer but he didn't even care...that b*stard :D )

    Oh my wife was pissed dude. I did not want to unleash the beast on him. We would have gone to jail. :)

    I have contacted a Ticket Fixer here in Houston to see what they can do. If they balk I will ask for deferred adjudication. The Judge is a graduate of the same law school I am a 3L at now. They may help...

    F**KING CONSTABLES. Stop pulling honest people over and go into the neighborhood and patrol for burglars. When my house got broken into there were probably 12 constables within a 2 mile radius sleeping in a median or writing $150 speeding tickets. :mad: :mad: :mad: :mad: :mad:

    I think it must be a conspiracy by the police to target people exceeding the legal speed limits.

    Ignore the ticket and wait to see if they really intend to pursue it to the legal conclusion that might reveal their true intent.

    The truth is out there Mulder.

    Few people understand the psychology of dealing with a highway traffic cop. A normal speeder will panic and immediately pull over to the side. This is wrong. It arouses contempt in the cop heart. Make the b*stard chase you. He will follow. But he won't know what to make of your blinker signal that says you are about to turn right. This is to let him know you're pulling off for a proper place to talk. It will take him a moment to realize that he's about to make a 180 degree turn at speed, but you will be ready for it. Brace for the g's, and fast heel-toe work.
