    DUI legislation didn't save anyone killed by drunk drivers this past weekend...let's get rid of it!

    Insane. You know what else pisses me off? A 20 year old black woman was missing for a week but the news didn't cover that until they found out she had been tortured and raped for a week by some deranged family. Every time a white girl comes up missing or dead we don't hear about jack **** else. I still occasionally hear about Natalie Hollaway.

    Even without the hate crime charges, aren't they in a heap of trouble? Kidnapping, rape, torture, assault... they are looking at very long prison terms. Do you think the hate crime will add much to their punishment? (I'm not asking rhetorically, I'm wondering, do you think it'll add much?)

    Eighth Amendment: "Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

    DUI legislation doesn't make it a tougher sentence simply because of the race of the victim. That's my only problem with hate crime legislation. I'd love nothing more than to see these guys rot in jail forever. However, I'd like to see them rot in jail forever even if the victim was white. Those that advocate hate crime legislation are implicitly saying that this wouldn't be as big of a deal or tragedy if the victim was white or the perpetrators were black. That's my problem with the whole "hate crime" thing.

    I view it like degrees of murder.. intent, etc.

    A man who steals someone's purse because he's literally going to die if he doesn't get something to eat isn't as bad as someone who embezzles tons of money, for no other reason than greed.

    A woman who kills a man for cheating on her with her best friend isn't the same as a woman who kills a man for being black.. or gay.. or white, for that matter.

    I don't know if their use of racial slurs does much to reveal their motivations to commit the crime, or even the victim they chose. Of course, there is plenty to the case I don't know about. But, if I was going to do something as evil as kidnap, rape, and torture someone for a week (and, I assume, murder her at the end), I'd probably heap on all the insults, slurs, and anything else I could say to be as hurtful as possible. You know a racial slur will hurt if you use it, even if racism was no part of your calculus when you decided to do the thing. So, for the hate crime -- which punishes motivation -- I don't think we've seen anything yet that shows that.

    But, I won't be surprised if there is more substantive evidence to come.

    And, I won't be too sad if they get slapped with that charge too.

    Some of the six suspects accused in the imprisonment and torture of a young black woman have extensive criminal histories, West Virginia court records show.

    According to county criminal complaints, Megan Williams, 20, was sexually assaulted, stabbed in the left leg, choked and beaten.

    Williams said one of the suspects cut her ankle with a knife while saying, "That's what we do to [racial slur] around here," police records show.

    The complaints say she was forced to eat rat and dog feces, lick up blood and drink from the toilet. The criminal complaints say the suspects threatened to kill Williams if she left the house where she was being held.

    The suspects are a woman and her son, a woman and her daughter, and two other men.

    "I have some familiarity with all those individuals," Logan County, West Virginia, Prosecutor Brian Abraham told The Associated Press, which said a study of records revealed a total of 108 criminal charges against the six since 1991.

    In this case, Frankie Brewster, 49, the woman who owns the mobile home in Big Creek, West Virginia, was charged with kidnapping, sexual assault, malicious wounding and giving false information during a felony investigation, AP reported.

    Brewster was charged with first-degree murder in 1994, but pleaded guilty to the lesser charge of manslaughter in the death of an 84-year-old woman. She was released in 2000 after serving five years in prison, according to court records cited by AP.

    Bobby R. Brewster, 24, Frankie Brewster's son, is charged with kidnapping, sexual assault, malicious wounding and assault during the commission of a felony.

    Danny J. Combs, 20, of Harts, West Virginia, is charged with sexual assault and malicious wounding.

    Karen Burton, 46, is charged with malicious wounding, battery and assault during the commission of a felony. Her daughter, Alisha Burton, 23, and George A. Messer, 27, are charged with assault during the commission of a felony and battery. All three are from Chapmanville, West Virginia.

    According to AP, Alisha Burton was charged in May with hitting Messer with a shovel and breaking another woman's car window. Burton was charged with domestic assault and battery and destruction of property, court records showed. Those charges are pending, AP reported.
