yeah so i was shooting in a forest, i guess a natural reserve, and not aiming at animals, a dude came up to me and said i am not allowed to shoot in here, told me to leave or he would call the cops (not that nicely though)....so yeah whats this country coming to you can even shoot stuff in a forest where theres nobody around? and also, if you work in the forest, arnt you suppose to have a uniform or something??

Hays County man cherged in shooting death of 7 year old boy

Man says he was shooting at a backyard target, not at the child, officials say.

Molly Bloom — Seven-year-old Daniel Galicia was jumping on a backyard trampoline in rural Hays County with his cousins Tuesday night when the shots rang out.

"We were jumping and playing, and when he stood up, he said, 'ouch,' " said Daniel's 8-year-old cousin Paola Diaz.

"I heard a shot, and then Daniel started to cry," Daniel's 7-year-old cousin Alexis Huarto said.

Daniel died at Brackenridge Hospital less than an hour after he was shot.

Sheriff's office investigators suspect the bullet that hit him came from a gun used by a 37-year-old man target-shooting in his nearby backyard.

Jose Barrera Espitia, who told police he couldn't even see the boy from his backyard, has been charged with manslaughter in Daniel's death. Espitia's High Road home is about a third of a mile from where Daniel and the other children were playing, in an area east of Kyle that has a mix of farmland and mobile homes.

Espitia was in the Hays County Jail on Wednesday, and bail had not been set, according to the Hays County sheriff's office.

When he was arrested early Wednesday, Espitia told deputies that he thought he had hit his wooden target with each shot and had no idea that anyone had been injured, officials said.

Fernanda Espitia, 16, the eldest of Espitia's three children, said her father, a construction worker, was crushed when he learned that Daniel had been shot.

The shooting was an accident, she said. "My dad would never do anything like that."

Daniel was a first-grader at Hemphill Elementary School in Kyle, Principal Mike Hanson said.

The boy was "just a great little kid" with a cherubic face, a big smile and buzz-cut hair that his classmates loved to touch, Hanson said.

Daniel wanted to be a police officer, his cousins said, and in his schoolwork he wrote that he loved pizza and candy and going to Sonic with his brothers and sisters.

Counselors were at the school Wednesday morning to talk to teachers and students, and the Hays school district sent letters to students' homes explaining what had happened, district officials said.

Daniel's cousin Beatriz Diaz, 21, said Daniel would get home from school, do his homework and then leap on the trampoline behind the house where his cousins live.

When the children were on the trampoline Tuesday night, shots came from "somewhere up there," Diaz said Wednesday, motioning with her chin to a row of yellow, gray and blue mobile homes.

Diaz stood a few yards from the trampoline, where the family dog was sleeping and an empty hammock swung from the tree next to it. Her nose was red from crying.

"We're all kind of shocked," she said. "Those kids would jump every day on the trampoline, and nothing happened until last night."

An initial phone call to authorities about 7:30 p.m. Tuesday indicated that Daniel had fallen from the trampoline, authorities said. Then a second call came in, saying the boy had been shot.

A neighbor, Felix Rangel, told deputies that he heard five or six shots come from a cluster of houses north of Daniel's house about the same time the boy was injured, according to court documents. Investigators then obtained a search warrant for Espitia's home and found a rifle.

Jose Rangel, 21, who lives near the Galicias down a gravel road, said he knows the family and tried to resuscitate Daniel with help from 911 operators.

"We were touching his shirt, but it was soaked in blood," Rangel said. "We tried to do what we could, but nothing was working in his body."

Espitia "was probably just shooting for fun," Rangel said. "But the only time we ever hear gunshots around here, usually, is during New Year's."

Before Tuesday, sheriff's deputies had never been called to the Espitia home for complaints about shooting, spokesman Leroy Opiela said. Espitia has no previous arrests, Opiela said.

Austin and other Texas cities ban the discharge of firearms within city limits. But Texas counties can prohibit the discharge of a weapon only on a lot smaller than 10 acres, said Sean Johnson, research attorney for Texas District and County Attorneys Association.

In counties that choose to do so, a violation is a Class C misdemeanor.

Hays County doesn't prohibit firing weapons, Opiela said.

Last year, a Hays County man concerned about his neighbors hunting on small lots asked the county commissioners to consider enacting such a ban, but the commissioners decided against it.

"Hays County is still a rural county, and people move here and think it is OK to shoot," Opiela said. "Houses in this area are pretty close together, and if you are shooting the wrong direction, something can happen like it did last night.

"We feel like it was reckless on his part to be shooting," he said.

Funeral arrangements for Daniel are pending with Mission Funeral Home. Diaz said Daniel's parents, Faustina and Julio Galicia, are planning to bury him in Mexico.

Jose Rangel said the shooting worries him and his family.

"I have a little sister who is a year and a half (old)," he said, looking at the little girl. "You move out of the city to feel safe and something like this happens. I can't feel safe anymore."

Safety tips for target shooting

•Check behind your target. Always make sure that a stray shot, or a bullet that penetrates its intended target, will be safely stopped by something else.

•Never shoot at a hard surface or at water; your shot might glance off, ricochet and injure someone.

•Never shoot at glass bottles, living trees or other targets that might create a hazard for people or damage the environment.

•Never shoot a rifle or handgun directly up or at a high angle of elevation. Even a .22-caliber bullet fired at an angle into the air can have enough force to kill a person 1 1/2 miles away.

•Never shoot across a roadway.

its an air gun, the pellets are 4.5 MM (smaller than standard airsoft gun). weighs about 7.9grams, max velocity is about 550 FPS, it doesnt have the power or speed to kill someone, heck, you cant even kill a rabbit with it. that said, i am very responsible with it, and the reason i was shooting it in the forest was because theres nobody around (except that douchebag)...i guess ill just nail a board to my garage and shoot that.

We used to shoot our pellet gun rifles in the woods around my house in Sugar Land. Although, I'm sure it's all houses now. (they just started to clear out some of the woods around the brazos when we were shooting....[9 years ago] )

Guns with no more power than that serve no purpose.

Perhaps it could have penetrated your eyeball.
