Bombshell's ma sees evil Stern

Howard K. Stern will have to testify in a Florida court this week, the first time Anna Nicole Smith's lawyer and companion will have to answer questions under oath.

The court appearance is to determine whether he remains as executor of Smith's will, who gets possession of her body for burial and ultimately who gets custody of Smith's infant daughter, Dannielynn.

But Stern's rivals - Smith's mother and a former lover who insists he is the real father of Dannielynn - suggest that Stern was an ominous presence around the former Playboy Playmate and her son, Daniel, and shouldn't be allowed near the baby girl.

David Lee, a friend of Smith's mother, Virgie Arthur, was blunt. "There are two common denominators in the deaths of her daughter and her grandchild - drugs and Howard K. Stern," Lee said.

When parcels of potent drugs like methadone, Demerol and Dalmane were allegedly delivered to a pregnant Smith in the Bahamas last August, Stern was her constant companion.

And when 20-year-old Daniel dropped dead of a drug overdose in Smith's Nassau maternity ward room Sept. 10, Stern was there, too.

The dark-haired lawyer, 38, claimed that Daniel "had a perfect night" visiting his mom and infant sister before he suddenly died and that "neither drugs nor alcohol were suspected."

Yet at least one witness is expected to testify next month at an inquest into Daniel's death that Stern gave the young man methadone, one of three prescription meds that allegedly killed him, and flushed the remainder of the drug down the toilet after Daniel died, a source in the Bahamian coroner's office told the celebrity Web site TMZ.com.

And Stern was in Florida with Smith, 39, when she dropped dead in a hotel room bed Feb. 8, surrounded by a load of pill bottles and holding a hefty stash of methadone in her fridge back home in the Bahamas.

Arthur will ask the court this week to remove Dannielynn from Stern's care because of his alleged "associations with drugs" and overall "lack of parental responsibility," said her attorney, Desmar Whitfield.

Shocking photos taken in September 2005 and obtained exclusively by In Touch magazine raise questions about Stern's possible complicity in the substance abuse by both Smith and her son.

One shows Stern holding up an obviously wasted Daniel, then 19, at a wrap party for his mom's straight-to-DVD movie "Illegal Aliens."

Another, taken at the same party, shows an apparently sky-high Smith with her arm around her toasted son, leaving little doubt that both Smith and Stern knew Daniel used drugs or alcohol.

Regulars on the set of Smith's spoof flick said she "could barely get her lines out" and one day passed out cold, sprawled on the floor, but Stern made excuses for her, blaming "exhaustion and skipped meals," In Touch said.

After Daniel's death, Smith spun further out of control. One December day, she was found unconscious in the pool and had to be dragged to safety and revived by Stern, according to an exnanny and another eyewitness.

"I don't know if it was an accident," witness Khristine Eroshevich told "Entertainment Tonight."

When Smith ran a 105-degree temperature two days before she died, Stern did not take her to a hospital. Instead, a private nurse gave Smith an ice bath to cool her down, but the cause of the alarming temperature spike was never determined, according to reports.

Dr. Marc Siegel of NYU Medical Center never treated Smith, but he wondered why a patient with such a high fever would not be taken to a doctor or a hospital.

"If someone has a 105-degree temperature, I want to know why," he said. "And if I don't know why, they go to the hospital."
