The Media is Inaccurate: We are Still above the cap

    You keep quoting Article VII, Section 8, Subsection k(1). I think that Subsection k(2) is much more important for this discussion. It says:

    It says right there in no uncertain terms, that exceptions and cap space cannot co-exist.

    yeah, I know. I agree k.2 is better. But that one is MUCH more complicated. Plus it is longer and my PDF version of this huge legal document is encrypted against cutting and pasting.

    Thanks Dwight a bunch for copying that. There is no doubt in my mind that they cannot coexist. I've got a suggestion into Larry Coon rewrite the FAQ in simpler terms. To me, the CBA is saying it bassackwards. It is so much easier to say,

    Exceptions count as Team Salary against the Cap. Once Team Salary falls below the Cap, you lose all your exceptions.

    Why don't they just say it that way????

    I do get....quite well in fact, but that is another story...

    Anyway, your post title regards the cap and whether we fall below it.

    I was having two seperate conversations at the same time with you (recall the other thread and our lengthy discussion)-whereever that thread is - idono!).

    The point I was making is.....

    For the actual cap ($42.5) we are below because our total salaries and unrenounced players count below this number once we ship Hakeem.....

    That being said

    Clearly, we exceed the cap (by the cumulative value of our exceptions) as specified by the CBA for FA signing purposes (other than exceptions of course).

    The reason we are so picky about the $42.5 mil number is it keeps the Mark Cubans of the world from going out and signing everybody. He can exceed the cap, but only by the specified allowable exceptions if possessed and specified contractual salary increases. Essentially, this was put in place to prevent exactly what is going on in MLB right now.....a playing feild that is clearly not level.

    Not in the NBA

    That was the charge. That is the result.
